Ferguson, Rhonda Ferguson, Rebecca Alberts, Robert Ferguson, Kathy Adkins, Unknown Persons/Owners, and Gary Linville, Sheriff of Lincoln County, West Virginia (hereinafter sometimes referred to as "the aforementioned respondents") that, pursuant to W. Va. Code 54-1-1, et seq., and 54-2-1, et seq., and all applicable West Virginia statutes, a hearing to determine just compensation will be held on August 7, 2026, at 10:00 a.m., in this action in the Circuit Court of Lincoln County, West Virginia, before Judge Jay M. Hoke in relation to a Petition for Condemnation/Right of Entry, which was filed and granted in the Circuit Court of Lincoln County, West Virginia, and is known as Civil Action No. 20-C-21, and styled Appalachian Power Company vs. Milton Ferguson Heirs, et al. Said just compensation hearing will address real property for the construction of electrical transmission, distribution, and communication lines and appurtenant equipment and fixtures, and condemnation and right of entry on behalf of Appalachian Power Company situate in Laurel Hill District, Lincoln County, West Virginia, and identified as Tax Map 6, Parcel 25, and recorded in Deed Book No. 128, at page 27, in the office of the Clerk of the County Commission of Lincoln County, West Virginia, and bounded and described as follows: 10 & 4 MILE OFF RT 10-9 83.5 AC SUR All of a certain parcel of land lying and being in the county of Lincoln State of W. Va. and on pound fork of four mile creek and in Laurel Hill district Bounded and described as follows to wit: Beginning at a stake on Rock Marked X in Creek and with meanders of branch and with Sylvadore Ferdanandez line to the top of the hill or ridge at a hickory corner and with Sylvadore Ferdanandez's line, to the line of Henry Pinson thence Henry Pinson line to a hickory, thence around ridge to a rock marked X in low gap thence to a black oak in next low gap thence around ridge to a hickory corner on tip of hill thence down the hill to head of a drain and with meanders of drain to main branch, thence with main branch to forks to a rock marked X, thence up the hill to an oak thence from oak down the hill to beginning corner containing 83 1/2 acres being the same more or less. The aforementioned respondents are hereby notified a copy of said Petition for Condemnation/Right of Entry may be obtained from the Lincoln County Circuit Clerk's office at 8000 Court Avenue, Hamlin, West Virginia, 25523, for the purposes of appearing and defending. The Petition for Condemnation/Right of Entry may also be obtained from the attorneys for Appalachian Power Company, Jeffrey A. Kimble, Post Office Box 128, 140 West Main Street, Suite 300, Clarksburg, West Virginia, 26302-0128, or Douglas C. McElwee, 700 Virginia Street East, Suite 400, Charleston, West Virginia, 25301. The aforementioned respondents are further notified that, at the said hearing to determine just compensation on August 7, 2026, at 10:00 a.m., in the Circuit Court of Lincoln County, West Virginia, located at 8000 Court Avenue, Hamlin, West Virginia, 25523, before the Honorable Jay M. Hoke and Commissioners, you may appear for hearing and presentation of evidence, and are notified that any failure to appear and/or present evidence may result in the waiver of any and all defenses or claims, if any, you may have regarding just compensation or otherwise in this action.
