PUBLIC NOTICE OF CHANGE IN RATES BY NON-LRR MUNI UTILITY
NOTICE is hereby given that City of Gary, public utility, has readopted by Resolution on June 16, 2026, a tariff containing increased rates, tolls and charges for furnishing water service to under 400 customers at Gary in the County of McDowell.

Rates:
Section 1:Title.This ordinance shall be referred to as, AN
ORDINANCE PROVIDING FOR THE
ADOPTION OF WATER RATES FOR THE
CITY OF GARY MUNICIPAL WATER
SYSTEM AND SAID CHANGES TO BE
EFFECTIVE FOR ALL BILLS DATED
JUNE 1, 2026, AND THEREAFTER
UNTIL SUBSEQUENT REVISION.
Section 2:Purpose.This ordinance is to revise the water rates of
the City of Gary.
Section 3:Applicability.The ordinance applies to all property within
the city limits of the City, with availability for
general, commercial, and industrial services.
Section 4:Rates.$19.31 per 1,000 gallons of water used
each month.
Section 5: Minimum5/8 inch meter – $57.93 per month;
Charge.3/4 inch meter – $86.90 per month;
1 inch meter – $144.83 per month;
1 1/4 inch meter – $211.44 per month;
1 1/2 inch meter – $289.65 per month;
2 inch meter – $463.44 per month;
3 inch meter – $868.95 per month;
4 inch meter – $1,448.25 per month;
6 inch meter – $2,896.50 per month;
8 inch meter – $4,634.40 per month.
No bill will be rendered for less than the above amounts,
according to the size of the meter installed.
Section 6:Sales forAll water for resale will be billed at the rate
Resale.of $5.66 per 1,000 gallons.
Section 7:DelayedThe above schedule is net. On all
Paymentaccounts not paid in full
Penalty.when due, ten percent (10%) will be
added to the net current
amount. This penalty is not interest and is
only to be collected once for each bill
where it is appropriate.
Section 8:ConnectionA fee of Two Hundred Fifty dollars
Charge.($250.00) will be charged for
each new connection to the system.
Section 9:Reconnection.A fee of Twenty dollars ($20.00) will be
charged for each time service is
reconnected to the system.
Section 10:Deposit.A fifty dollar ($50.00) deposit to secure
delinquency required on new and
reconnection accounts and maintained
for twelve (12) months, at which time it will
be applied to customers account.
Section 11:Separability.If any provision or part thereof is declared
invalid, the remainder shall not be affected
thereby.
Section 12:EffectiveThis ordinance shall become effective
Date.forty-five (45) days after its adoption and
publication as required by law.
There are no resale customers of the City of Gary.
The increases shown are based on averages of all customers in the indicated class. Individual customers may receive increases that are greater or less than average. Furthermore, the requested rates and charges are only a proposal and are subject to change (increases or decreases) by the Public Service Commission in its review of this filing. The Commission shall review and approve or modify the increased rates only upon the filing of a petition within thirty (30) days of the first publication of this notice of adoption of the ordinance changing said rates or charges, by:
(1) Any customer aggrieved by the changed rates or charges who presents to the Commission a petition signed by not less than twenty-five percent of the customers served by such municipally operated public utility; or
(2) Any customer who is served by a municipally operated natural gas public utility and who resides outside the corporate limits and who is affected by the change in said rates or charges and who presents to the Commission a petition alleging discrimination between customers within and without the municipal boundaries. Said petition shall be accompanied by evidence of discrimination; or
(3) Any customer or group of customers of a municipally operated natural gas utility who are affected by said change in rates who reside within the municipal boundaries and who present a petition to the Commission alleging discrimination between said customer or group of customers and other customers of the municipal utility. Said petition shall be accompanied by evidence of discrimination.

A complete copy of the proposed rates, as well as a representative of the utility to provide any information requested concerning it, is available to all customers, prospective customers, or their agents at any of the following offices of the utility:
