NOTICE OF TRUSTEE’S SALE Under authority of that certain Deed of Trust dated September 15, 2016, from David Earl Newton, Sr. aka David E. Newton to Marc B. Lazenby, Trustee, of record in the office of the Clerk of the County Commission of Wayne County, West Virginia in Trust Deed Book No. 779, at page 99, securing a promissory note in the principal amount of $64,736.82, payable to Vanderbilt Mortgage and Finance, Inc., and default having been made under the promissory note secured by the aforesaid Deed of Trust and sale requested by Vanderbilt Mortgage and Finance, Inc., the undersigned Trustee will offer for sale at the front door of the Wayne County Courthouse in Wayne, West Virginia on July 17, 2026 at 3:00 p.m., subject to all reservations, exceptions, easements and other matters which appear of record, and subject to all unpaid taxes, if any, the following described property, together with the improvements thereon and appurtenances thereunto belonging, situate at 1910 Right Fork West Road on the waters of Gimlet Creek in the Westmoreland District, Wayne County, West Virginia. As shown on a plat of survey by Timothy L. Keely – WVPS No. 972 dated August 24, 2016. Being more particularly described as follows: Beginning at a point near the outlet of a 24″ corrugated metal drain pipe on the southern right of way of Right Fork West Road – Secondary Route 60/6, said point is situate 517′ from the northeastern corner of the 18-1/3 Acre Tract, thence with said right of way S 70 14′ 00″ E, 58.00′ to a point; thence S. 82 19′ 00″ E, 89.00′ to a point; thence N. 77 34′ 00″ E, 47.00′ to a point; thence N 60 55′ 00″ E, 148.00′ to a point; thence leaving said right of way and now running down the hill making a new division line through the 18-1/8 acre tract, S 25 53′ 00″ E, 101.00′ to a 12″ pear tree, and continuing S 25 53′ 00″ E. 84.00′ to a 18″ walnut tree, and continuing S 25 53′ 00″ E, 80.00′ to a point; thence S 74 03′ 25″ W, 377.00′ to a point; thence N 13 43′ 49″ W, (124′) to a point in the center of a 20′ road right of way, thence crossing said road and continuing (176′) being a total of a 300.00′ to the point of beginning, containing 2.00 Acres, more or less. There is a Twenty (20) Foot Road Right Of Way from Right Fork West Road – Secondary Route 60/6 through part of the 18-1/8 Acre tract to Access this 2.00 Acre Parcel and the residue of the 18-1/8 Acre Tract, as shown on the aforesaid survey.
