The Petitioner, the West Virginia Department of Human Services, has filed a petition alleging that JONATHAN SMITH and ERIC BARRETT have abused and neglected, abandoned, or failed to provide for the care, custody and control of infants D.F., whose date of birth is July 30, 2021 and D.F., whose date of birth is June 7, 2025. It is ORDERED that JONATHAN SMITH and ERIC BARRETT are to appear in the courtroom of the Honorable David J. Sims, Judge of the Circuit Court of Ohio County, West Virginia, Fifth Floor, Ohio County Courthouse, Wheeling, WV on the 13th day of July, 2026 at 1:30 p.m. for an Adjudicatory Hearing if they so desire to object or make other defenses to the Petition; otherwise JONATHAN SMITH, biological father of infant D.F., whose date of birth is July 30, 201 and ERIC BARRETT, putative biological father of infant D.F., whose date of birth is June 7, 2025, may adjudicated as an abusive and neglectful parents.
