NOTICE OF TRUSTEE’S SALE
By virtue of the execution of a certain deed of trust
dated September 8, 2015, recorded in the Office of the
Clerk of the County Commission of Wetzel County,
West Virginia, in Trust Deed Book 390, page 233, made
and executed by, Jacqueline N. Piekarski and Michael
J. Piekarski, husband and wife, to Ronal W. Rush,
trustee, to secure Bayer Heritage Federal Credit Union,
a corporation, any by virtue of the execution of a certain
deed of trust dated April 22, 2016 recorded in the Office
of the Clerk of the County Commission of Wetzel
County, West Virginia in Trust Deed Book 395, at page
534, made and executed by Jacqeline N. Piekarski and
Michael J. Piekarski, husband and wife, to Ronal W.
Rush, trustee, to secure Bayer Heritage Federal Credit
Union, a corporation, in the payment of the deed of trust
obligation therein fully set forth, and Carolyn G.
Flannery, whose address is 233 Main Street, New
Martinsville, Wetzel County, West Virginia,
having been appointed as Successor Trustee by
“Appointment of Successor Trustee Agreement”
recorded in the aforesaid Clerk’s Office in Trust Deed
Book 470, page 142, and the said Trustee having been
required by the said beneficiary so to do, the
undersigned Trustee will sell said property to the highest
and best bidder at the front door of the courthouse in
Wetzel County, West Virginia, at New Martinsville, West Virginia, on August 4, 2026 at 3:00 p.m.
Said deed of trust property, with the appurtenances
thereunto belonging, situate in Martin’s Addition to the
City of New Martinsville, Magnolia District, Wetzel
County, West Virginia, and bounded and described as
follows:
Beginning at a stone corner at the southwest corner of
the intersection of Martin Avenue and Virginia Street;
thence with the southerly line with Virginia Street in a
westerly direction 118 feet to a stake at the intersection
of an alley with said street; thence with the eastwardly
line of said alley in a southerly direction 32 feet to a
stake corner to Malls lot, formerly William Koontz, and
with the same eastwardly 118 feet to a stone corner in
the west side of Martin Avenue and thence with the west
side of said street northwardly 38 feet to the place of
beginning, which said lot fronts 38 feet on Martin
Avenue, 118 feet on Virginia 32 feet on the alley in the
rear thereof, said lot being part of Lot 58 in said addition
as the same appears on the recorded plat of said
Martin’s Addition in the Wetzel County Clerk’s Office in
Plat Book No. 1, at page 40.

Being the same property conveyed unto Michael J.
Piekarski and Jacqueline N. Piekarski, husband and
wife, by William D. Stuart and Rae Ellen Stuart,
husband and wife, by deed dated May 9, 2001, and
recorded in the office of the Clerk of the County
Commission of Wetzel County, West Virginia, in Deed
Book 372, page 326.

This conveyance is made subject to all reservations,
exceptions, grants of rights of way and easements
made by the grantors and their predecessors in title as
recorded in the said Wetzel County Clerk’s Office.

TERMS OF SALE :
1. The property is being conveyed in an ” AS IS
“physical condition by Deed containing no warranty,
express or implied, subject to the Internal Revenue
Service right of redemption, all property taxes, prior
Deeds, liens, reservations, encumbrances, restrictions,
rights of way, easements, covenants, conveyances
and conditions of record in the said Clerk’s Office or
affecting the subject property.
2. The purchaser shall be responsible for the payment
of the transfer taxes imposed by West Virginia Code
§ 11-22-1.
3. The beneficiary and/or the servicer of the Deed of
Trust and Note reserve the right to submit a bid for the
property at sale.
4. The Trustee reserves the right to continue the sale of
the subject property from time to time by written or oral
proclamation, which continuance shall be in the sole
discretion of the Trustee.
5. The Trustee shall be under no duty to cause an
existing tenant or person occupying the property to
vacate said property, and any personal property and/or
belongings remaining at the property after the
foreclosure sale will be deemed to constitute
ABANDONED PROPERTY AND WILL BE DISPOSED
OF ACCORDINGLY.
6. The total purchase price is payable to the Trustee by
certified or cashier’s check on the day of sale.

The Petitioner, the West Virginia Department of Human Services, has filed a petition alleging that JONATHAN SMITH and ERIC BARRETT have abused and neglected, abandoned, or failed to provide for the care, custody and control of infants D.F., whose date of birth is July 30, 2021 and D.F., whose date of birth is June 7, 2025. It is ORDERED that JONATHAN SMITH and ERIC BARRETT are to appear in the courtroom of the Honorable David J.
