NOTICE OF TRUSTEE’S SALE
By virtue of the execution of a certain deed of trust
dated October 16, 2019, recorded in the Office of the
Clerk of the County Commission of Wetzel County,
West Virginia, in Trust Deed Book 424, page 801, made
and executed by, William Lee McClain, to Ronal W.
Rush, trustee, to secure Bayer Heritage Federal Credit
Union in the payment of the deed of trust obligation
therein fully set forth, and Logan Hassig, whose
principal residence is 505 Greenbriar Court, New
Martinsville, Wetzel County, West Virginia, having been
appointed as Successor Trustee by “Appointment of
Successor Trustee Agreement” recorded in the
aforesaid Clerk’s Office in Trust Deed Book 470, page
73, and the said Trustee having been required by the
said beneficiary so to do, the undersigned Trustee will
sell said property to the highest and best bidder at the
front door of the courthouse in Wetzel County, West
Virginia, at New Martinsville, West Virginia, on
August 4, 2026 at 2:00 p.m.
Said deed of trust property, with the appurtenances
thereunto belonging, situate in Wetzel County, West
Virginia, and is more particularly described as follows, to-wit:
FIRST TRACT: The following described property,
situate in the Village of Steelton (now, City of New
Martinsville) Magnolia District, Wetzel County, West
Virginia, more particularly described as follows:
Being all of Lot Number eight (8), in the Harvey A.
Gross Subdivision to the Village of Steelton, Magnolia
District, Wetzel County, West Virginia, as laid down,
designated and described on the recorded plat of said
Subdivision, recorded in the Office of the Clerk of the
County Court [Commission] of Wetzel County, West
Virginia, in Plat Book No. 2, at page 41, to which plat
reference is here made for a more particular description
of said lot. This lot is 50 feet x 105 feet, and fronts 50
feet on the East side of a 40 foot [wide] street,
SECOND TRACT: All that certain lot, parcel or tract of
land, together with the improvements thereon and
appurtenances thereunto belonging, situate in Magnolia
District, Wetzel County, West Virginia, and more
particularly described as follows:
Situate in the City of New Martinsville, Magnolia District,
Wetzel County, West Virginia, being all of Lot Number
Ten (10), in the Harvey A. Gross Subdivision to the City
of New Martinsville (formerly Village of Steelton),
Magnolia District, Wetzel County, West Virginia, as laid
down, designated and described on the recorded plat of
said Subdivision, recorded in the Office of the Clerk of
the County Commission of Wetzel County, West
Virginia, in Plat Book Number 2, at page 41, to which
plat reference is here made for a more particular
description of said lot.
Being the same property conveyed unto William Lee
McClain by Keiser McClain II, Trustee of the Peggy L.
McClain Irrevocable Living Trust, Keiser McClain II and
Donna Lee McClain, by deed dated the 21 st day of
April, 2005 and recorded in the Office of the Clerk of the
County Commission of Wetzel County, West Virginia in
Deed Book 398, at page 332.
TERMS OF SALE :
1. The property is being conveyed in an ” AS IS
“physical condition by Deed containing no warranty,
express or implied, subject to the Internal Revenue
Service right of redemption, all property taxes, prior
Deeds, liens, reservations, encumbrances, restrictions,
rights of way, easements, covenants, conveyances and
conditions of record in the said Clerk’s Office or affecting
the subject property.
2. The purchaser shall be responsible for the payment
of the transfer taxes imposed by West Virginia Code
§ 11-22-1.
3. The beneficiary and/or the servicer of the Deed of
Trust and Note reserve the right to submit a bid for the
property at sale.
4. The Trustee reserves the right to continue the sale of
the subject property from time to time by written or oral
proclamation, which continuance shall be in the sole
discretion of the Trustee.
5. The Trustee shall be under no duty to cause an
existing tenant or person occupying the property to
vacate said property, and any personal property and/or
belongings remaining at the property after the
foreclosure sale will be deemed to constitute
ABANDONED PROPERTY AND WILL BE DISPOSED
OF ACCORDINGLY.
6. The total purchase price is payable to the Trustee by certified or cashier’s check on the day of sale.
