Separate sealed Bids for the Broomstraw/Mark Meador Road Waterline Extension the Jumping Branch-Nimitz Public Service District, which consists of waterline extensions along Broomstraw Road and Mark Meador Road. The Broomstraw Road extension and Mark Meador Road extension will tie into the Madam Creek extension, a project that is simultaneously ongoing. A finished water storage tank, booster station and pressure reducing valve station will be necessary. Bids will be received by Gary Browning, Chairman, at 120 Ballengee Street, Suite 106, Hinton, WV 25951 until 1:30 P.M., local prevailing time, on August 27, 2026, and then the Summers County Memorial Building at 451 First Avenue, Hinton, WV 25951 in the Auditorium on the third floor, publicly opened and read aloud.
The Contract Documents may be examined at Thompson & Litton, 1105 Mercer Street, Princeton WV; and online at TRASCO (http://www.trascoplanroom.com).

A mandatory Pre-Bid Conference will be held on August 13, 2026, at 11:00 A.M. All interested parties are required to meet the Engineer at 451 First Avenue, Hinton, WV 25951 in the Auditorium on the third floor, at that time and can be accessed using the following weblink: "https://www.microsoft.com/en-us/microsoft-teams/join-a-meeting" and utilize meeting ID 250 688 819 123 986 and pass code DQ6j76ZL. Following the conference, a field review of the project area will be held for all BIDDER's.
Each Bidder must submit with his bid security in the amount, form, and subject to the conditions provided for in the Instructions to Bidders.
1)Bidders shall comply with Executive Order 11246, entitled, "Equal Employment Opportunity," as amended by Executive Order 11375 and as supplemented in Department of Labor regulations (41 CFR Part 60).
This is a federally assisted project. Bidders and Contractors performing work under this advertisement are bound by the requirements of President's Executive Order 11246 as amended by Executive Order 11375; Title VI of the Civil Rights Act of 1964; Section 109 of Title I of the Housing and Community Development Act of 1974, as amended; Section 3 of the Housing and Urban Development Act of 1968; the Immigration Reform and Control Act of 1986; the Davis-Bacon Act; the Copeland "Anti-Kickback" Act; the Contract Work Hours and Safety Standards Act; and Public Law 100 202.
Any contract or contracts awarded under this invitation for bids are expected to be funded in part by grants and loans from: the West Virginia Department of Environmental Protection State Revolving Fund. Neither the United States, the State of West Virginia nor any of their departments, agencies or employees are or will be a party to this invitation to bid or any resulting contract.
TWO ENVELOPE BID SYSTEM
A two envelope system will be used.
Envelope No. 1 must have the following information presented on the front:

The bid opening procedure shall be a two-envelope system. The system shall consist of two separate and distinct envelopes each with proper identification. The first envelope shall be identified as "Bid Opening Requirements" and the second as "Bid Proposal". Both shall be submitted in a single, large envelope, labeled with the Contractor's Name, Contractor's Address, Name of the Project, and the Contract Number. The first envelope shall contain the items identified within Article 2 of the Bid Form (Section 00 4143). The second envelope ("Bid Proposal") shall consist solely of the Bid Form itself. The second envelope will not be opened if all the required attachments identified in Article 2 of the Bid Form (Section 00 4143) are not included and completed, the Bidder will be declared nonresponsive. The lowest responsive bidder shall be the bidder who has completed all the requirements for the first envelope and has the lowest total on the bid form.

AMERICAN IRON AND STEEL REQUIREMENT
P.L. 113-76, Consolidated Appropriations Ace, 2014 (Act), includes an "American Iron and Steel (AIS)" requirement in section 436 that requires Clean Water State Revolving Fund (CWSRF) and Drinking Water State Revolving Fund (DWSRF) assistance recipients to use iron and steel products that are produced in the United States for projects for the construction, alteration, maintenance, or repair of a public water system or treatment works.
NONDISCRIMINATION IN EMPLOYMENT
BIDDERS on this work will be required to comply with the President's Executive Order No. 11246. The requirements for bidders and contractors under this order are explained in the specifications.
SUSPENSION AND DEBARMENT
Bidders shall not entertain the use of businesses that are listed on the "System for Award Management (SAM)" at www.sam.gov in accordance with 2 CFR Part 1532 and Subpart B and C of 2 CFR Part 180.
WV ALCOHOL AND DRUG FREE WORKPLACE ACT
West Virginia Code 21-1D-5 provides that any solicitation for a public improvement construction contract requires each vendor that submits a bid for the work to submit at the same time an affidavit of compliance with the bid. The Drug Free Workplace affidavit enclosed in the contract documents must be signed and submitted in the first envelope as evidence of the Vendor's compliance with the provisions of Article 1D, Chapter 21 of the West Virginia Code. Failure to submit the signed Drug Free Workplace Affidavit in the first envelope shall result in disqualification of such bid.
NOTICE OF FEDERAL WAGE REQUIREMENTS
Contractors are required to comply with all laws pertaining to federal wage rates as issued in accordance with the Davis Bacon Act. The contractor will be required to pay the federal wage rates appropriate for each worker classification.
DISADVANTAGED BUSINESS ENTERPRISES REQUIREMENTS
Each Bidder must fully comply with the Disadvantaged Business Enterprises and Affirmative Action Requirements as identified in the contract documents.
The Bidder agrees to make "positive efforts" to sub-contract a portion of the total value of the Contract to Disadvantaged Business Enterprises. This shall be done in compliance with the six (6) affirmative steps as outlined in 40 CFR 33.240. Failure to demonstrate positive efforts to do so may lead to rejection of bids. For the purpose of this program, the term "subcontract" includes all construction, modification, and service work contracted for by the bidder in the execution of the work under this contract.
The contractor shall not discriminate on the basis of race, color, national origin or sex in the performance of this contract. The contractor shall carry out applicable requirements of 40 CFR Part 33 in the award and administration of contracts awarded under EPA financial assistance agreements. Failure by the contractor to carry out these requirements is a material breach of this contract which may result in the termination of this contract or other legally available remedies.
U. S. ARMY CORPS OF ENGINEERS
This construction of this project will be funded in part with funds made available from the Federal Government through the US Army Corps of Engineers Section 340 program. Bidders must comply with all applicable laws and regulations for construction projects receiving Federal aid including, but not limited to, the Civil Rights Act of 1964, the Contract Work Hours and Safety Standards Act, and the Davis-Bacon Act as amended
FUNDING AGENCIES
Agencies funding the project include the Summers County Commission with American Rescue Plan Act funds, the West Virginia Department of Environmental Protection Drinking Water Treatment Revolving Fund, the West Virginia Bureau for Public Health, the West Virginia Infrastructure & Jobs Development Council, and the West Virginia Water Development Authority, United States Army Corps of Engineers, Housing and Urban Development Community Development Block Grant, and Appalachian Regional Commission. Contributions have been made by the Jumping Branch-Nimitz Public Service District and the West Virginia American Water Company.
LIQUIDATED DAMAGES
In the event that the Project does not reach a substantial completion within the time specified in Paragraph 4.02 of the Agreement Between Owner and Contractor for Construction Contract (Stipulated Price) for substantial completion, the Contractor shall pay the Owner One Thousand Four Hundred Twenty Four Dollars and Twenty Cents ($1,424.20) a day until such time as substantial completion is achieved.
This Bid will remain subject to acceptance for 90 days after the Bid opening, or for such longer period of time that Bidder may agree to in writing upon request of Owner.
The Contract(s) shall be awarded to the lowest responsive and responsible Bidder(s).
The Owner reserves the right to reject any and all Bids if it appears in its best interest to do so.
