ORDER FOR PUBLICATION

The object of the above-entitled action is for violations of the City of Beckley Municipal Code of Ordinances. The said property is in violation of the following provisions of the International Property Maintenance Code: §302.4 and §302.8, as well as in violation of §15-23(s) of the City of Beckley Municipal Code. The Respondents, his/her/
its heirs, successors, and/or assigns, are the recorded owners of the subject property. The subject property is identified on tax maps of Raleigh County in the City of Beckley District, on Map 41, as Parcel 01210000, further described as Wildwood Add Lot 7. The property has an address of 1300 S. Kanawha Street, Beckley, West Virgina. Being the same property Walter G. Edwards and Nancy B. Edwards acquired the subject property described as Wildwood Add Lot 7, with an address of 1300 S. Kanawha Street, Beckley, West Virgina by Deed, dated June 15, 1940, from Atlantic Life Insurance Company, of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Book 166, at page 246. Walter G. Edwards and Nancy B. Edwards are both deceased. Respondents are believed to the best of the Petitioner's knowledge to be the known living heirs of Walter G. Edwards and Nancy B. Edwards.

It appearing by Affidavit filed in this action that the location of the Respondents heirs are unknown, or that there may be Respondent (s) unknown and Respondent (s) who are nonresidents of the State for whom no agent or appointed or statutory agent or attorney in fact is found in the State upon whom service may be had to Petitioner. It is ORDERED that Respondent(s), known and unknown, which may claim any interest in the above-mentioned property, appear before the Municipal Court of the City of Beckley, and Judge Matthew Fragile. It is hereby notified that on the 20th day of August, 2026, at 1:30 p.m., or as soon thereafter as counsel can be heard, the City of Beckley, will appear before the Municipal Couty of the City of Beckley, Raleigh County, West Virginia, Judge Fragile, at 169 Industrial Drive, Beckley, West Virginia, for the further proceeding with respect to said violations of the City of Beckley Municipal Code of Ordinances. Failure to appear could result in a judgement entered against the Respondent(s), including, but not limited to: fines; order authorizing the Petitioner to enter the subject property to cut all vegetation, clean up rubbish and/or garbage on the property, tow all inoperable vehicles, repair and/or secure structure(s) and/or the demolition of said structure(s), and/or take all necessary measures necessary to bring the property into compliance with City of Beckley Municipal Code; of which all costs of said actions by the Petitioner will result in liens filed against the subject property; as well as any and all other relief that may be justified by the Court.
