NOTICE OF SALE. Notice is hereby given as is required by the provisions set forth in West Virginia Code §35-1-1, et seq., "Property of Religious, Educational and Charitable Organizations" that on or after July1, 2026, Stephen E. Elderbrock, Senta M. Goudy, and James J. Rowe as successors to the Trustees of the Trinity Presbyterian Church, will convey and confirm that certain real estate more particularly described below, together with the improvements and appurtenances, located at 118 E Whitby Road, Raleigh County, Shady Springs, West Virginia 25813, to buyer or Stephen E. Elderbrock, Senta M. Goudy, and James J. Rowe, Trustees for the Presbytery of West Virginia of the Presbyterian Church (U.S.A.). In addition, notice is hereby given as required by the provisions set forth in West Virginia Code §35-1-1, et seq., that on or after July 1, 2026, for and in consideration of the sum of Ten Dollars ($10.00), cash in hand paid, and other good and valuable considerations, Stephen E. Elderbrock, Senta M. Goudy and James J. Rowe, Trustees for the Presbytery of West Virginia of the Presbyterian Church (U.S.A.), will sell and convey the following described real estate, together with improvements and appurtenances, 118 E. Whitby Road, Raileigh County, Shady Springs, West Virginia 25813, to Benny Harper, Shady Springs Pentecostal Holiness Church:
All that certain lot or parcel of land situate in Shady Springs, Raleigh County, West Virginia and more particularly bounded and described as follows:
TRACT TWO: BEGINNING at a fence post in concrete at the intersection of U.S. Highway No. 19-21 and the road leading to Big Beaver; thence with the west right of way line, of U.S. 19- 21N. 6 deg. 42' E. 177.7 feet to a fence post corner to County Infirmary; thence leaving the road right of way line and with two lines of the County Infirmary S. 64 deg. 15' W. 309.8 feet to a fence post; S. 26 deg. 43' E. 158.6 feet to a fence post on the north side of road leading to Big Beaver; thence with the north side of said road N. 61 deg. 54' E. 211.9 feet to the beginning, containing 0.91 acres, more or less.
TRACT THREE: BEGINNING at a hub, a corner to the Shady Spring Elementary School House Lot, now owned by the party of the first part; thence with the right-of-way line of U.S. Highways Nos. 19 and 21, N. 2 deg. 10' E. 100 feet to a hub; thence leaving the right-of-way line to the highways, S. 71 deg. 32' W. 224 feet; thence S. 15 deg. 43' W. 169.6 feet to a hub set in the line of the school property belonging to the party of the first part; thence with the line of the school property, N. 62 deg. 00' E. 286.3 feet to the place of the beginning.
The above tracts being the same property conveyed to the predecessor of the party of the first part by deed dated April 5, 1978, of record in the Office of the Clerk of the County Commission, Raleigh County, West Virginia in Deed Book 597, at page 92 to which reference is made.
This description is intended to describe the property containing the church building and the ancillary structures, but not that parcel previously conveyed and which is currently under development.
