The herein described real estate of the Matthew W. Cox, shall be sold at public auction on the Courthouse steps in Romney, Hampshire County, West Virginia, on Thursday, March 3, 2016, at 10:00 a.m.
Said real estate will be sold pursuant to the authority vested in the undersigned, by the provisions of that certain Deed of Trust executed by Matthew W. Cox, unto H. Charles Carl, III, and/or William C. Keaton, Trustees, to secure unto The Bank of Romney, a banking corporation, the beneficial owner of that certain Deed of Trust, dated the 3rd day of May, 2010, and of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed of Trust Book 514, at Page 761. Default having occurred relative to the covenants and conditions as set forth in said Deed of Trust, and the undersigned Trustee, having been instructed in writing by the beneficial owner so to do, will offer the hereinafter described real estate for sale at public auction to the highest responsible bidder at the front door of the Courthouse in Romney, Hampshire County, West Virginia, on Thursday, March 3, 2016, at 10:00 a.m., which said property is more particularly described as follows:
All those two certain tracts or parcels of real estate lying and being situate in Springfield District, Hampshire County, West Virginia:
First Parcel: All that certain lot or parcel of real estate, with the improvements and appurtenances thereunto belonging, situate on the west side of West Virginia Route 28, and contiguous thereto, approximately one mile north of the Town of Springfield, in Springfield District, Hampshire County, West Virginia, said real estate being more particularly bounded and described as follows:
“Beginning at a large walnut tree in the west line of West Virginia Route No. 28; thence N. 23 W., along said highway 208 feet to a hickory; thence leaving the road S. 60 15 W., 314 feet to a stake in the back line of the 4 acre 40 rod tract; thence along the line of the 4 acre 40 rod tract, N. 83 15 E., 22 feet; thence S. 63 30 E., 155 feet; thence S. 89 30 E., 86.5 feet; thence N. 69 E., 108 feet to the beginning, containing one (1) acre, more or less, and being bounded on the north by other real estate belonging to John L. Steward; on the south and west by the Augusta Allender Home Place, and on the east by W. Va. Route No. 28.”
And being the same real estate conveyed unto Matthew W. Cox, married, by deed of Steven Michael Clower and Penne K. Clower, his wife, dated July 12, 2001, of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed Book No. 407, at page 458. Said real estate is shown on the Hampshire County Land Books as being all of Tax Map 18, parcel 59.1 for said district.
Second Parcel: All that certain tract or parcel of real estate containing 5.00 acres, more or less, situate in Springfield District, Hampshire County, West Virginia, lying on the southeastern side of West Virginia County Numbered Route 1, about 2.2 miles northeast of the intersection of said Route 1 and West Virginia Numbered Highway 28, as shown on that certain Plat of Survey and described on that certain Description of Survey prepared by Richard L. Moreland, Professional Surveyor, which said Description and Plat are of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed Book No. 470, at pages 236 and 237, and are by reference made a part hereof for all pertinent and proper reasons, including a more particular description of the real estate herein conveyed. Said real estate is shown on the Hampshire County Land Books as being all of Tax Map 19, parcel 70 for said district.
Said real estate is subject to that certain 40 foot wide non-exclusive right of way, as shown on the above referenced plat, for the use and benefit of the owners of the adjoining real estate.
And being the same real estate conveyed unto Matthew W. Cox and Sherri L. Cox, his wife, by deed of Nathan E. Travis and Christine E. Travis, his wife, dated July 30, 2008, and which said Deed is of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed Book No. 476, at page 719. And further, Second Parcel being the same real estate in which Sherri L. Cox conveyed all of her right, title and interest unto Matthew W. Cox by deed dated April 14, 2010, of record in the aforesaid Clerk’s Office in Deed Book 489, at page 494.
The property will be conveyed in an “AS IS” condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the aforesaid Clerk’s Office or affecting the subject property.
The Beneficiary and/or the Servicer of the Deeds of Trust and Note reserve the right to submit a bid for the property at sale.
The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
Terms of the sale are 10 percent cash down to be paid on day of sale, and the balance to be paid by certified or cashiers check within 30 days of the date of the sale.
