NOTICE OF
TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated June 10, 2010, executed by Borrowers, Jefferson D. Stone and Rhonda L. Stone, to Brian Gartley, the Trustee of record in the office of the Clerk of the County Commission of Ohio County, West Virginia, in Book 1396, at Page 508. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 217 Middle Creek Road, Triadelphia, WV 26059. Pill & Pill, PLLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated March 16, 2016, of record in the Clerk’s Office in Book 1522, at Page 1. The borrowers defaulted under the Note and Deed of Trust and the Substitute Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Ohio County, in Wheeling, West Virginia, on the following date:

11:45 a.m.
The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Triadelphia Town District, Ohio County, West Virginia, and being more particularly described as follows:

A certain parcel of land, situate on the northerly side of Middle Wheeling Creek, in the town of Triadelphia, in the Triadelphia District of Ohio County, West Virginia, bounded and being more particularly den rlhod as follows.

Beginning at a point located at the northwesterly corner of the grantors tract herein, Said point is also located at a corner common with a 1.225 acre parcel of land that was conveyed to William J. Lawhorne and Tamara Jo Lawhorne, by deed dated January 18, 1999 and of record in the Office of the Clerk of the County Commission of Ohio County, West Virginia in Deed Book 710 at Page 298.

Thence, from the said place of beginning, and with the westerly line of the grantors, and also witht the lands of the said Lawhorne, South 36 degrees 09′ West (at 227.08 feet, and at 321.2 feet, passing through iron bars, and at 339.88 feet, passing the centerline of the present paving of Middle Wheeling Creek Road)for a total distance of 408.42 feet to a point in Wheeling Middle Creek. Thence; down the creek, South 54 degrees 52′ East for a distance of 86.78 feet to a point in the said creek. Thence, leaving Middle Wheeling Creek, and now through the lands remaining to the grantors herein, with a line that is parallel to and 14.00 feet distant to the masonry wall of the garage apartment, North 36 degrees 09′ East passing an iron bar set online at 70.00 feet, passing an iron bar set on line at 210.00 feet, for a total distance of 414.47 feet to a point located in the northern line of the grantors tract herein. Thence, with the same, North 58 degrees 51′ West for a distance of 87.10 feet to the place of beginning, containing 0.818 acres, more or less, as shown upon a plat attached hereto and intended to be made a part of the this description.

Being a part of the same parcel of land containing 1.258 acres, more or less, that was conveyed front Annetta Vercellotti and Quinto Vercellotti to Philip Vercellotti by a deed dated July 30,1955 and recorded in the said Clerk’s Office in Deed Book 371 at Page 474.
The above described parcel of land is subject to that part of the right away for Middle Wheeling Creek road, that is included within its boundary lines.

The above described parcel of land is made subject to any and all conditions, exceptions, reservations or stipulations that are referred to in this deed or all prior deeds of record, and also to any and all easements or rights of ways in former deeds of conveyance.
