The object of the above entitled action is to partition among those entitled thereto the following described lands, located in Wheeling, Ohio County, West Virginia, an undivided interest in which defendants Thorton Archer, John Davis, Christine Evans, Mildred Miller, Ruth E. Peterson, Mary L. Sherman, Willis E. Williams, Lois A. Florio, Ann D. Miller, Katherine A. Wicai, Janet A. Lorinez, Barbara Ann Magnone and the surviving heirs of any deceased defendant, may have:
Plat of Old Town, Part of Lot Number 36 in the District of Wheeling
It appearing by affidavit filed in this action that after due diligence, the residence or whereabouts of defendants Thorton Archer, John Davis, Christine Evans, Mildred Miller, Ruth E. Peterson, Mary L. Sherman, Willis E. Williams, Lois A. Florio, Ann D. Miller and Janet A. Lorinez has not been determined; that there may be persons other than those names who are heirs of any such deceased defendants and who may have an interest in said lands, whose names are unknown to plaintiff, and who are made parties to the complaint filed in this action by the general description of unknown surviving heirs of any deceased defendants;
It therefor is
ORDERED that each of those named above and any unknown heirs shall serve upon Lester C. Hess, Jr., plaintiff’s attorney, whose address is 1226 Chapline Street, P.O. Box 351, Wheeling, West Virginia, 26003, an answer or other defense to the complaint filed in this action on or before June 10, 2016, otherwise judgment by default will be taken against them at anytime thereafter. A copy of said complaint can be obtained from the undersigned Clerk at her office lcoated at Room 403, Ohio County Courthouse, 1500 Chapline Street, Wheeling, West Virginia, 26003.
