NOTICE OF SALE UNDER DEED OF TRUST Under authority of certain Deed of Trust from Lucinda Coleman, dated the 26th day of July, 2011 and recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Book 879, at page 633; default having been made in the payment of the obligations secured by said Deed of Trust and sale having been requested by the beneficial owner, the undersigned will offer for sale at the front door of the Courthouse of Fayette County, Fayetteville, West Virginia, on Tuesday, June 21, 2016 at 1:00 o’clock p.m., that certain real estate conveyed by said Deed of Trust as described on the Exhibit “A” attached hereto and made a part hereof. EXHIBIT “A” PROPERTY DESCRIPTION FOR LUCINDA L. COLEMAN The following described tract or parcel of surface land, together with the improvements and appurtenances thereunto belonging and the right incidental thereto, situate at Adena Village, Valley District, Fayette County, West Virginia, and being more particularly bounded and described as follows, to-wit: Lot No. 25 Section 1 as shown and designated on that certain map entitled “Adena Village Section One Adena Development Corporation, Valley District, Fayette County, W.Va.”, prepared by S.E. Thornton, P.E., dated May, 1974 of record in the office of the Clerk of the Fayette County Commission, Fayette County, West Virginia. And being the same property acquired by Lucinda L. Coleman, by deed dated June 23, 2011, from Marshall T. Coleman, to be recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, prior to or simultaneously herewith. And being the same property heretofore acquired by Lucinda Coleman by Deed dated the 22nd day of July, 2011, from Marshall T. Coleman, and of record in the Office of the Clerk of the County Commission of Fayette County, West Virginia in Deed Book 671, at page 193. TERMS OF SALE 1. The property will be sold and conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to any Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances, and conditions of record in the Clerk’s office or affecting the subject property. 2. The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code c 11-22-2. 3. The Beneficiary and/or the Servicer of this Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4. The Trustee reserves the right to continue the sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5. The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate the property and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6.
