NOTICE is hereby given of the intention to sell by sealed bid the pro-perty located in Greenbrier County ,WV. Known as parcel 10 1901-4600000000, is situated at 129 W Washington St, Lewisburg, WV and is more particularly described as; “All of that certain lot or parcel of land with the buildings and improvements thereon, situate, lying and being in the Town of Lewisburg, Greenbrier County, WV, fronting thirty-seven (37) feet and six (6) inches, more or less, on the south side of Main St at the corner of Market or Court St in said Town and running back between parallel lines ninety(90) feet, being what is known as the Lewisburg Drug Store Property.”
TERMS: Sealed bids are to be submitted by June 25, 2016 to Mike Tyree, Receiver, Century 21 First Choice Inc, P O Box 1026, Beckley WV 25801. The subject property will be sold “AS IS” condition. The successful bidder shall deposit with the Receiver, by money order or by certified or cashiers check payable to “Department of Justice “a deposit in an amount of between five and twenty percent of the winning bid as the sale, potential bidder shall display to the Receiver proof that they are able to comply with this requirement. Balance due and payable within 60 days of the sale. If the bidder fails to fulfill this requirement , the deposit shall be for-feited. The sale of the real property shall be subject to the confirmation of the United States District Court for the Southern District of West Virginia in accordance with the Order entered on April 22, 2016, in the case of United States of America v. Gerard O’Shea, et al., Civil Action No. 5:12-cv-04075. On confirmation of the sale, the Receiver, on behalf of the United States, shall execute and deliver the deed conveying the real property to the purchaser(s). On con-firmation of the sale, all interests and liens asserted against, or claims to the real property, that are held or asserted by all parties to this case shall be discharged and extinguished.
