The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust dated January 8, 2014, and duly recorded in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Deed of Trust Book 726, at Page 664, Russell Allen Hinkle and Jackie Ann Hinkle did convey unto Otis L. O’Connor, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Greenbrier County Courthouse, in Lewisburg, West Virginia, on
Wednesday, July 27, 2016, at 8:30 AM
The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Blue Sulphur District, Greenbrier County, West Virginia, and more particularly described as follows:
All that certain tract or parcel of land together with the improvements thereon and the appurtenances thereunto be-longing, situate and being in Blue Sulphur District, Greenbrier County, West Virginia, and more particularly bounded and described as follows:
TRACT ONE:
Beginning at a ½ inch iron pipe set on the south side of an access road through the Cadle tract, a corner to Guy E. Harris and from which a line bears N. 02-27 W. 65.68 feet to a ½ inch iron pipe found on the southwest corner of the James K. Hoke tract; thence with the line of Harris, S. 24-34 W. 197.57 feet to a ½ inch iron pipe, set; thence continuing with the line of Harris, S. 40-35 W. 90.84 feet to a ½ inch iron pipe set on the line of Charles E. Shawver, a corner to Harris and from which a line bears S. 77-55 E. 714.75 feet to a 2 inch iron pipe, a parent tract corner; thence with the line of Shawver, N. 77-55 W. 238.08 feet to a 3/8 inch iron pipe set on the Shawver line; thence leaving the line of Shawver and through the Cadle tract, N. 40–33 E. 173.10 feet to a ½ inch iron pipe, set; thence continuing through the Cadle tract, N. 24-34 E. 302.72 feet to a ¾ inch iron pipe set on the southwest side of the access road; thence with the southwestern side of the access road, S. 33-06 E. 248.33 feet to the Beginning, and containing 1.84 acres, more or less, as surveyed by Greenbrier Surveying Company in March, 1995.
TRACT TWO:
Beginning at a ¾ inch iron pipe found on the south side of an access road through the Cadle tract, a corner to Clarence W. Becraft; thence with the line of Becraft, S. 24-34 W. 302.72 feet to a ½ inch iron pipe, found; thence continuing with the line of Becraft, S. 40-33 W. 173.10 feet to a ¾ inch iron pipe found on the line of Charles E. Shawver, a corner to Becraft and from which a line bears S. 77-55 E. 952.83 feet to a 2 inch iron pipe, a parent tract corner; thence with the line of Shawver, N 77-55 W. 238.90 feet to a  ¾ inch iron pipe found on the line of Shawver, a corner to Eddie A. Koonce; thence leaving the line of Shawver and with the line of Koonce, N 40-33 E. 337.56 feet to a ½ inch iron pipe, found; thence continuing with the line of Koonce, N 24-34 E. 289.93 feet to a ¾ inch iron pipe found on the southwest side of the access road; thence with the southwest side of the access road, S 38-56 E. 210.00 feet to the Beginning and containing 2.51 acres, more or less, as surveyed by the Greenbrier Surveying Company in March, 1995.
The property herein conveyed is Subject to the following restrictions, reservations and limitations:
All Mineral rights in said land are hereby reserved.
1. No portion of the land hereby conveyed shall be sub-divided into smaller lots.
2. There shall be no mobile homes, house trailers or other trailers situate on this property with exception that there may be travel trailer or motor homes used for vacation purposes only situate on the property.
3.   Any utility buildings erected on said land shall be set a minimum of fifteen (15) feet from the property line.
4.  There shall be no business of any kind situate on the real estate conveyed herein.
5. There shall be no unlicensed, inoperable motor vehicles of any kind on said property at any time.
6.   The road into the property shall be used for ingress, egress and regress of all the property owners in Cadle Woods Subdivision and shall be used with care and respect to the other property owners in said subdivision.
7. The property owners shall be responsible for maintaining the road and for snow removal.
8.   The owner of any house or building under construction shall repair any damage to the road incurred during construction.
9.   The party of the second part hereby agrees that they will construct one residence on the combined tract of the property herein conveyed.
AND BEING the same real estate which was conveyed to Russell Allen Hinkle and Jackie Ann Hinkle by Deed dated December 10, 2013, from Veston V. Vaughan and Michelle Vaughan, and recorded in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Deed Book 562, at Page 300.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
