TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated November 10, 2011, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Document No. 50450055, in Book No. 5045, at Page 0055, John McKinnon and Kristen McKinnon did convey unto Douglas Hayes, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated July 21, 2016 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Wells Fargo Bank, N.A. to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse in Beckley, West Virginia, on September 16, 2016 at 9:30 a.m. the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Beckley District, Raleigh County, West Virginia, and more particularly described as follows: The surface of that certain real estate located within the municipality of Beckley, Raleigh County, West Virginia, and more particularly described as follows: BEGING the surface, together with any appurtenances thereon, of a part of Lot 1, Section 1, as the same appears on a map entitled “Section One, V.A. Homesites to Hart-Nixon Addition, Beckley, West Virginia”, recorded in the office of the Clerk of the County Court of Raleigh County, West Virginia, in Map Book 11, at page 40, which said part of said lot is more particularly bounded and described as follows: BEGINNING at a stake on the east side of Hart Street, a corner to Lot No. 1 and Lot No. 2, Section 1, V.A. Homesites; thence with Hart Street N. 27 f 0′ W. 9.34 feet to a stake; thence N. 48 f 43′ W. 52.66 feet to a stake; thence through Lot No. 1, N. 21 f 40′ E. 87.44 feet to a stake, a corner of Lot No. 10 and Lot No. 11 of Section 12, South Beckley Addition; thence with back line of Lots Nos. 11, 12, 13 and part of 14, Section 12, South Beckley Addition, S. 73 f 50′ E. 169.58 feet to a stake, a common corner to Lots Nos. 1 and 2, Section 1, V.A. Homesites, and to Lot No. 13, Section 1, Mercer Street Extension to hart-Nixon Addition; thence with line of Lots Nos. 1 and 2, S 63 f 0′ W. 169.86 feet to the beginning, containing 12,235.97 square feet, and more particularly described by a more recent survey as follows: Beginning at a steel pin (set) in the northern right-of-way line of Hart Street, said point being the common corner of Lots 1 and 2 of “Section 1, V.A. Homesites to Hart-Nixon Addition; thence leaving said Lot 2 and with Lot 1 and Hart Street, N 27 f 00′ W, 9.34 feet to a point; and N 48 f 43; W. 52.66 feet to a steel pin (set); thence leaving Hart Street and with a new line through said Lot 1, N 21 f 40′ E. 87.44 feet to a steel pin (set) at the common corner of Lots 10 and 11 of “Section 12, South Beckley Addition”; thence with the common line between said Lot 1 and Lots 11, 12, 13 and 14 of “Section 12, South Beckley Addition”, S 73 f 50′ E, 169.58 feet to a steel pine (set) in the line of said Lot 14, said point being the common corner of Lots 1 and 2 of “Section 1, V.A. Homesites to Hart-Nixon Addition”; thence leaving said Lot 14 and with the common line between said Lots 1 and 2, S 63 f 00′ E. 169.86 feet to the point of beginning and containing 12,235.97 square feet, more or less. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 101 Hart Street, Beckley, WV 25801. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $9,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
