To Whom it may concern:
The purpose of this action is to advise Lonnie David Smith that a Petition for Forfeiture was filed on September 9, 2015, pursuant to the West Virginia Contraband Forfeiture Act, West Virginia Code § 60A-7-701 et seq., because it is money that was furnished in exchange for a controlled substance, in violation of Chapter 60A of the West Virginia Code, or it is money that has been used or is intended to be used to facilitate a violation of Chapter 60A of the West Virginia Code.
It appearing that the whereabouts of Lonnie David Smith are presently unknown, it is ORDERED that Lonnie David Smith respond within 30 days and object, or make other defense, to the Petition, otherwise the United States currency shall be disposed of in accordance with West Virginia Code § 60A-7-701 and other applicable law, and the proceeds of disposition shall be distributed pursuant to that same law.
Further, it is hereby ORDERED that Lonnie David Smith be advised of his right to have counsel at every stage of these proceedings and that counsel will be appointed and failure to respond may result in the forfeiture of the United States currency.
