NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE NOTICE is hereby given that default having been made under the terms of a Deed of Trust dated March 6, 2009, and of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Trust Deed Book 5034, at page 9313, executed by Ronald D. Hodge, Director, for Baptist Ambassadors to America to Alan R. Terry and Carl W. Roop, Trustees, securing Pioneer Community Bank, which was given to secure the payment of the note therein described, and demand having been made upon the undersigned so to do, the undersigned Trustee, Carl W. Roop will, on the 2nd day of December, 2016, at the front door of the Raleigh County Courthouse, in the City of Beckley, West Virginia, at 9:00 a.m., sell the property hereinafter described, which property was conveyed in said Deed of Trust, and being more particularly described as follows: The surface of those two certain tracts or parcels of land situate on the waters of Crab Orchard, Town District, Raleigh County, West Virginia, and being more particularly described as follows: FIRST TRACT: BEGINNING at an iron pin on the Soak Creek Road about 265 from the intersection of the Soak Creek Road and Route 16, a common corner to the original Green Jessup property and the property of Mary E. Brammer and G. M. Brammer, her husband, and thence with the Soak Creek Road S. 1 f 04′ W. 234.8 feet to a stake in the edge of the Soak Creek Road and thence through the property of Mary E. Brammer and G. M. Brammer, her husband, N. 64 f 08′ W. 945.6 feet to a stake in the line of Beaver Coal Company, N. 14 f 37′ E. 151.6 feet to a stake a common corner to the original Green Jessup property, and thence with the original Green Jessup property, S. 68 f 17′ E. 879.4 feet to the point of beginning, and containing 4.05 acres, more or less. SECOND TRACT: BEGINNING at a stone on the old Sophia Road and running with the same North 15 rods to a chestnut a corner to W. M. Horton; thence Northwest with said Horton 175 feet to a stone; thence Southwest about 15 rods to a stone; thence a straight line to the beginning, containing one acre, more or less. And being the same property conveyed to Baptist Ambassadors to America by Deed dated the 24th day of February, 2009, from Carl E. Adkins and June E. Adkins, his wife, which said Deed is recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5034 at page 9311. There is also hereby conveyed an easement from Carl E. Adkins and June E. Adkins, his wife, to the Crab Orchard-MacArthur Public Service District, dated the 20th day of July, 1996, and recorded in the aforesaid Clerk’s Office in Book 98, at Page 2860. There is also hereby conveyed an easement from Carl E. Adkins and June E. Adkins, his wife, to the Crab Orchard-MacArthur Public Service District, dated the 5th day of June, 1997, and recorded in the aforesaid Clerk’s Office in Book 113, at Page 2639. There is hereby EXCEPTED and RESERVED a tract or parcel of land being a part of 4.05 acre tract of land, located along Blue Room Road in the vicinity of Midway, Town District, Raleigh County, West Virginia, and being more particularly described as recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5040 at page 9440. Further, there is hereby EXCEPTED and RESERVED from this Deed a tract or parcel of land being a part of 4.05 acre tract of land, located along Blue Room Road in the vicinity of Midway, Town District, Raleigh County, West Virginia, and being more particularly described as recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 5043 at page 8629. Said property will be sold upon the following terms and conditions: 1. Cash in hand on day of sale. 2. The property will be conveyed in an “AS IS” condition by Deed containing Special Warranty of Title, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, validly enforceable prior liens, reservations, encumbrances, restrictions, right-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 3. The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4. The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5. The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, or remove any personal property and/or belongings remaining at the property. 6. The purchaser(s) at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property. 7. In the event there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
