To The Above-Named Respondent:
It appearing by affidavit in this action that Nicholas Thomas Dolinger, the Respondent, has an unknown address, and that the Petitioner, Devin Phillips, has used due diligence to ascertain the residence or whereabouts of the Respondent, without effect. It is hereby ordered that the Respondent serve upon the Petitioner’s attorney, Todd A. Kirby, Esq., of Kirby & Ashley, L.C., whose address is 207 South Heber Street, Suite 1B, Beckley, West Virginia 25801, an Answer, including any related counterclaim or defense you may have to the Petition for Divorce filed in this action. The Respondent shall have thirty (30) days from the date of publication of this Order to file an Answer and/or Counterclaim. A hearing is scheduled on this Petition on September 12, 2018 at 10:30 a.m. at the Raleigh County Judicial Center, 222 Main Street, 2nd Floor, Beckley, West Virginia, before the Honorable H. Suzanne McGraw. If you fail to Answer the Petition for Divorce, a judgment may be taken against you for the relief demanded in the Petition.
