PROPOSED CONVEYANCE
OF UNITED METHODIST CHURCH PROPERTY

(Abney Union Church)

(Coal City Charge)

Notice is hereby given that the Board of Trustees of the West Virginia Annual Conference of the United Methodist Church will, on or after August 27, 2018 QUITCLAIM, GRANT and CONVEY to the Trustees of the Regular Baptist Church, the Trustees of the Missionary Baptist Church, and the Trustees of the Primitive Baptist Church all of their right, title and interest, in and to that certain tracts or parcels of land, lying in Town District, Abney, Raleigh County, West Virginia and bounded and described as follows:
BEGINNING at a set stone on the West side of the County Road, said set a tone being S. 71 43′ E. 853.95 feet from a stake where a Maple and Chestnut Oak stood, the common corner of Tract 1 (Charles Hill) Tract 188 (Sullivan Land Company) and Tract 188a (Sullivan Land Company) as the said Tract 1, Tract 188, Tract 188a, and all numbered and named tracts hereinafter mentioned and described (except those tracts acquired by the Beaver Coal Company since January 19, 1904,) are numbered, named and shown on a general map entitled “Map of Tracts of Land in Raleigh County, West Virginia, conveyed to the Beaver Coal Company by deeds dated January 19, 1904, from Piney Coal Company et al.,” attached to and forming part of a certain deed dated January 19, 1904, from the White Stick Coal Company to the Beaver Coal Company, recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book No. 29, at Page 1 etc., said general map being on Page 55 of said Deed Book No. 29, the said beginning point being also the Southeast corner of a 0.25 of an acre cemetery lot, the second exception form Tract No. 1 in the Deed from the Sullivan Land Company to the Beaver Coal Company, dated the 4th day of May, 1921, and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book No. 77, at Page 61; thence S. 58deg. 10′ W (Passing a set stone, the Southwest corner of the said 0.25 of an acre cemetery lot at 66 feet) 145.30 feet to a stake; thence S. 28deg. 58′ E. 300.00 feet to a stake; thence N. 58deg. 10′ E. 145.30 feet to a stake on the West Side of the county road; thence following the West side of said County Road N. 28deg. 58′ W. 300.00 feet to the point of BEGINNING: Containing by estimation one (1) acre, more or less, and being part of Beaver Coal Company Tract 188a (Sullivan Land Company).
The Deed dated June 16, 1922 referred to hereinbelow contained the following language set forth herein in the following three (3) paragraphs:
(1) For the purpose of more accurately defining the location and boundaries of the above described lot, or parcel or piece of surface land, the said parties of the first part have attached to this Deed a special map of the above-described lot, parcel or piece of surface land, entitled, “Map of a Tract of One acre of surface conveyed by the Beaver Coal Company and the Battleship Coal Company to the Trustees of the Abney Union Church of Abney, West Virginia, by deed dated the 16th day of June, 1922” which is made a part hereof and is to be taken and read as a part of the description hereinbefore set forth.
(2) IN TRUST, for the several but equal use and benefit of the said Methodist Episcopal Church, Regular Baptist Church, Missionary Baptist Church and Primitive Baptist Church, subject to the discipline, usage and ministerial appointments of said Churches respectively, as from time to time may be authorized and declared; PROVIDED, HOWEVER, that in case a successor to any of said Trustees (or to a successor Trustee) shall be appointed by the religious denomination which he represents, the authority hereby vested in each said Trustee to whom a successor may be appointed as aforesaid, shall, by reason of such appointment upon the recognition by the Judge of the Circuit Court of said Raleigh County be vested in each such successor so appointed from time to time by said religious denomination. If at any time the said lot or parcel shall be used for any other purpose than religious purposes, the title to the said lot or parcel of surface land shall thereupon revert to and be re-vested without any demand, re-entry or further or other proceeding being required therefore.
(3) IN CASE ANY of the said four religious denominations shall so cease to use the said land and buildings for its religious services and purposes, the then trustee for that denomination, under the terms of this Deed, shall and will execute, acknowledge and deliver to the then Trustees of the said other religious denominations, a Deed of Conveyance, conveying, releasing and surrendering, in a form which shall be approved by the parties of the second part hereto, all the estate, right, title, interest, property, claim and demand of the said religious denomination so withdrawing, in and to the said lot or parcel of surface land, and any and all buildings which may be erected thereon.

And being the same property conveyed to Trustee of the Methodist Episcopal Church, Trustee for the Regular Baptist Church, Trustee for the Missionary Baptist Church and Trustee for the Primitive Baptist Church, from the Beaver Coal Company, by Deed dated June 16, 1922 and recorded in the aforesaid Clerk’s Office in Deed Book 82, at Page 167, reference to which is hereby made. The Coal City Charge of the United Methodist Church (the successor to the Methodist Episcopal Church) was discontinued by the regular session of the 2017 West Virginia Annual Conference of the United Methodist Church, and therefore no longer utilizes the aforesaid property.
