Proposed Annexation
of One Area of 545.9 Acres, More or Less, and a
Second Area of 162.5 Acres, More or Less, by the
City of Smithers
The City of Smithers has filed an application with the Fayette County Commission for the annexation by minor boundary adjustment pursuant to the West Virginia Code 8-6-5. A public hearing regarding the proposed annexation will be held on September 14, 2018 at 11:30 a.m. in the chambers for the Fayette County Commission on the first floor of the Fayette County Courthouse located at 100 Court Street, Fayetteville, WV. This is a public hearing.
The complete amended application for annexation with map is available at the office of the Clerk of the County Commission for Fayette County located in the Fayette County Courthouse or at the Smithers city hall located at 518 Michigan Avenue, Smithers, WV.
A summary of the City of Smithers’ plan for providing services to the additional territories is as follows:
1. There are currently no residents living in nor businesses located in the proposed areas for annexation.
2. Police protection in the areas proposed for annexation will be provided by the Smithers Police Department, the Fayette County Sheriff’s Department, and the West Virginia State Police.
3. Fire protection in the areas proposed for annexation will be provided by the Smithers Volunteer Fire Department with mutual aid from other area fire departments.
4. There is presently no public water service in either area proposed for annexation and as there are no businesses located in nor residents living in either proposed area there is no need for such services at this time.
5. There is presently no sanitary sewer service in either area proposed for annexation and as there are no businesses located in nor residents living in either proposed area there is no need for such services at this time.
6. There are presently no public roads or streets in either area proposed for annexation and as such there is no need for street maintenance in either proposed area.
7. There are no businesses nor residents living in either area proposed for annexation and as such there is no need for waste collection services in either area at this time.
8. An approval of the proposed annexation should have no impact on fire protection and fire insurance rates in the areas proposed for annexation as there are no persons residing in either area and as there are no businesses located in either area.
9. The City of Smithers is seeking to annex the proposed area to expand the boundaries of the City with an eye toward future economic development and land conservation.
