The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated July 31, 2014, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Document No. 50560775, in Book No. 5056, at Page 775, and modified in Document No. 50666180, in Book No. 5066, at Page 6180, Nicolas Lee Hunt did convey unto Andrew C. Skinner, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated April 26, 2018, and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by JPMorgan Chase Bank, National Association, to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse in Beckley, West Virginia, on
October 12, 2018 at 12:30 p.m.
the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Town District, Raleigh County, West Virginia, and more particularly described as follows:
All that certain tract of land being a part of Lots No. 54 and 55 of the Bailey Addition No. 2 containing 0.238 acres, situated in the Town of Bradley, in the Town District of Raleigh County, West Virginia, located at 132 Biggs Street. Being a part of the same tract of land conveyed by Daniel D. Ferrell and Eva Rahe Ferrell to Eva Dannette Farrell by Deed dated the 15th day of July, 1991, recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Micro Film Roll 13 at Page 101. Said tract being bounded and more particularly described as follows:
TRACT ONE
Beginning at a 5/8″ rebar w/cap (set), at intersection of the southern right of way line of 8th Street, a 30′ right of way, and eastern right of way line of Biggs Street, a 30′ right of way. And being the North West corner of Lot No. 54 of the Eva Dannette Ferrell (MR 13 – PG 101) tract. Thence leaving the eastern right of way line of said Biggs Street, and with southern right of way line of said 8th Street and the line of said Lot No. 54 and Lot No. 55. Said Lot No. 55 being a part of the said Ferrell tract; N 81deg. 08′ 41″ E 100.00′ to a 5/8″ rebar w/cap (set), on the southern right of way line of said 8th Street, and being a common corner to Lot No. 55 of the said Ferrell tract, and Lot No. 56 of the Kimberly Renne Hatfield etal (MR 21 – PG 1722) tract. Thence leaving the southern right of way line of said 8th Street, and with the common line of said Lots No. 55 and 56; S 08deg. 51′ 19″ E 108. 78′ to 5/8″ rebar w/cap (set), a new corner on the common boundary line of said Lots No. 55 and 56. Thence leaving the common boundary line of said Lots No. 55 and 56, and with a new line through said Lots No. 54 and 55; N 80deg. 04′ 52″ W 139.57′ to a 5/8″ rebar w/cap (set), on the eastern right of way line of said Biggs Street, and being a new corner on the line of said Lot No. 54. Thence with eastern right of way line of said Biggs Street and the line of said Lot No. 54; N 17deg. 51′ 44″ E 71.50′ to the point of beginning, containing 0.238 acres, more or less, as surveyed by ESI Services, Inc. Beckley, West Virginia.
And being part of the same property conveyed from Daniel L. Ferrell and Eva Rahe Ferrell, his wife unto Eva Danette Ferrell, their daughter, by Deed dated the 15th day of July, 1991, and of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Deed Roll 13 at page 101.
In Deed Roll 60 at page 2032, Daniel D. Ferrell and Eva Rahe Ferrell retained unto themselves a Life Estate in the aforementioned property. In Deed Roll 63 at page 2128, said life estate grant was corrected to remove this property from the Life Estate provision in Deed Roll 60 at page 2032. Daniel D. Ferrell died on October 12, 2002. Eva Rahe Ferrell died on February 16, 2003. Eva Dannette Ferrell died intestate on January 23, 2013. On March 4, 2013, Kellie Williams became the Administratrix for the Estate of Eva Dannette Ferrell. Ms. Williams obtained Plat of Resurvey for the Eva Danette Ferrell Estate. Said Plat Map is attached hereto and the property herein is identified as Tract One.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 132 Biggs Street, Bradley, WV 25818.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $5000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
