The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated October 30, 2006, and duly recorded in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Document No. 38081, in Book No. 596, at Page 127 reformed in Document No. 259987, in Book No. 61, at Page 348, Mary Jo Sharp did convey unto Seneca Trustees, Inc., Trustee(s), certain real property described in said Deed of Trust; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by CIT Bank, N.A., to foreclose thereunder, will offer for sale at public auction at the front door of the Greenbrier County Courthouse in Lewisburg, West Virginia, on
November 9, 2018 at 9:00 AM
the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Lewisburg District, Greenbrier County, West Virginia, and more particularly described as follows:
That certain lot or parcel of real estate designated as Unit 4, Cluster A, Greenbrier County Villas, Inc., together with the buildings and improvements thereon, easements, rights of way, and the appurtenances thereon belonging, situate in Lewisburg District, Greenbrier County, West Virginia, and more particularly bounded and described as follows:
Beginning at a 3/4 iron pipe set on the southwest side of Oak Lane, the access street leading on to Greenbrier County Villas, Inc., property and from which a line bears S 41-09 E 17.39 feet to the center of a water well; thence leaving the access street and with the line of Greenbrier County Villas, S 31-40 W 89 .48 feet to a 3/4 inch iron pipe set on the line of Virgil Dunn, Jr. And from which a line bears S 66-29 E 20.94 feet to a Vepco transformer pole #ND47; thence with the line of Virgil Dunn, N 60-08 W 38.08 feet to a 3/4 inch iron pipe set on the line of Dunn; thence leaving the line of Dunn and with the line of Unit 3 in Cluster A of Greenbrier Villas, N 31-40 E 88.37 feet to a point near the center of a common use concrete driveway and on the southwest side of the access street; thence with the southwest side of the street, S 61-48 E 38.14 feet to the beginning and containing 3,384 square feet as surveyed by Greenbrier Surveying Company in June 1989. And being the same property conveyed unto Mary Jo Sharp by deed from Julie S. Bryant and K. Lance Bryant, dated December 21, 1997, and of record in the aforesaid Clerk’s office in Deed Book 447 at page 885.
PARCEL TWO: That certain lot, tract or parcel of land together with the buildings and improvements thereon, easements, rights of way, and the appurtenances thereon belonging, situate in Lewisburg District, Greenbrier County, West Virginia, and more particularly bounded and described as follows:
Beginning at a 3/4 inch iron pipe found on the southwest right-of-way line of Oak Lane and being the northeastern lot corner of Cluster A, Unit 4, of Greenbrier County Villas; thence leaving the northeastern lot corner of Cluster A, Unit 4, and with the southwest right-of-way line of Oak Lane, S 61-4 7-52 E 12.11 feet to a 1/2 inch rebar set on the southwest right-of-way line of Oak Lane; thence with a new division line marked by a chainlink fence through the property of Greenbrier County Villas, Inc., S 31-30-33 W passing a chainlink fence post on line at 29. 7 feet and passing the other end of said chainlink fence at 89 .4 feet, in all a total of 89 .82 feet to a wood fence post corner on the line of Virgil Dunn, Jr., (DB 231, Pg461); thence with the line of Virgil Dunn, Jr., N 60-08-00 W 12.34 feet to a 3/4 inch iron pipe found on the line of Virgil Dunn, Jr., and on the southeast lot corer of Unit 4, Cluster A, of Greenbrier Villas, Inc.; thence leaving the line of Virgil Dunn, Jr. and with the eastern lot line of Unit 4, Cluster A, N 31-40-00 E 89.48 feet to the beginning and containing 0.025 acre, more or less, as surveyed by Greenbrier Surveying in December, 1997.
There is further conveyed a right of way and easement for the use of the access road to the subject property. And being the same property conveyed unto Mary Jo Sharp by deed from Greenbrier County Villas, Inc. dated January 7, 1998, and recorded in Deed Book 447 at page 882.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 101 Old Oak Ln, Lewisburg, WV 24901.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
