NOTICE OF
TRUSTEE’S SALE
Pursuant to the authority vested in the undersigned Campbell Woods, PLLC, Substitute Trustee by Notice of Substitution of Trustee which notice is of record in the Office of the Clerk of the County of Commission of Ohio West Virginia, and by Deed of Trust dated April 28, 2017, executed by Joshua C. Benyo to Richard A. Pill, Trustee, which deed of trust is of record in the Office of the Clerk of Ohio County, West Virginia, in Trust Deed Book 1544 at Page 639, the undersigned Substitute Trustee has been requested, in writing, by the beneficiary of said deed of trust to sell the real estate described below, as there has been a default under the terms and conditions of said deed of trust. Therefore, the undersigned Substitute Trustee will sell the real estate described in the Deed of Trust, at a public auction on April 12, 2019 at 2:00 p.m. to the highest bidder at the front door of the Courthouse of said County of Ohio, in wheeling, West Virginia, which real estate is more completely described as follows:
The following parcel of land situated on the easterly side of Birch Avenue, between Edington Lane and South Park Street, Edgewood, in the City of Wheeling, Wheeling District, (formerly Triadelphia District), Ohio County, West Virginia, and comprising that part of Lot Numbered Eleven (11) as shown on the “Map of Birch Lynn”, said map being recorded in the office of the Clerk of the County Court of Ohio County, West Virginia, in Plat Book 2, at page 5, that is occupied by Apartment 9, of Metz Terrace said parcel being more particularly bounded and described as follows:
Beginning at a stake in the easterly line of Birch Avenue, said stake being located N. 23* 48′ W. 150 and 19/100 feet, measures along the easterly line of Birch Avenue from its intersection with the northerly line of Edington Lane, said stake being also in the southwesterly extension of the center line of the partition wall between Apartments 8 and 9; thence leaving Birch Avenue and with the said southwesterly extension and then with the center line of the partition wall between Apartments 8 and 9 and its northeasterly extension, N. 65* 47′ E. 66 and 52/100 feet to a stake in the division line between the westerly line of Carmel Road and the easterly line of Lot 11; thence with the division line between the westerly line of Carmel Road and the easterly line of Lot 11, S. 17* 31′ E. 19 and 99/100 feet to a stake in the northeasterly extension of the center line of the partition wall between Apartments 9 and 10; thence leaving the division line between the westerly line of Carmel Road and the easterly line of Lot 11 and with the said northeasterly extension and then with the center line of the partition wall between Apartments 9 and 10 and its southwesterly extension, S. 65* 55′ W. 64 and 33/100 feet to a stake in the easterly line of Birch Avenue; thence with the easterly line of Birch Avenue, N. 23* 48′ W. 19 and 74/100 feet to the place of beginning; being the same property occupied by Apartment 9, as shown on the photostatic copy of the Map of the Subdivision of Metz Terrace, prepared by Stegman & Schellhase, Inc., Registered Engineers, which said photostatic copy is recorded in said County Clerk’s office in Deed Book 334, at page 45, and by reference is made a part of this deed.
TERMS OF SALE
1. Cash in hand paid on the day of sale.
2. The sale of the property will be made subject to all matters having priority over the deed of trust referred to herein including but not limited to any and all assessments and taxes against said property, all prior liens, encumbrances, lease, restrictions, covenants, conditions, rights of way and easements of any nature whatsoever.
3. The purchaser shall be responsible for the payment of the transfer taxes imposed by West Virginia Code Section 11-22-2.
4. The subject property will be sold in “AS IS” condition. The Substitute Trustee makes no representations and warranties of any kind or character including, but not limited to, the condition of the real estate or the title to the real estate to be conveyed.
5. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
6. The Substitute Trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of the sale described above.
7. The beneficiary of the Deed of Trust and holder of the note thereby secured reserves the right to submit a bid for the property at the sale, which bid may be in the form of a credit bid.
8. Such other terms as may be announced at the time of Sale.
