By virtue of that certain Deed of Trust made by Kyle T. Doyle and Carol Doyle, his wife, to John E. Gompers, Trustee, dated the 30th day of August, 2017, and of record in the office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed of Trust Book No. 1551, at page 521, and that certain Appointment of Successor Trustee, dated the 4 day of June, 2019, and of record in the aforesaid County Clerk’s office in Deed of Trust Book No. 1593, at page 438, the undersigned will sell at public auction, and subject to the terms and conditions set forth in this Trustee’s Notice of Sale and in the said Deed of Trust, on the 17th day of July, 2019, at 10:00 o’clock A.M., at the northwest front door of the Court House of Ohio County, Wheeling, West Virginia, a certain parcel of land more particularly described as follows:
All that certain parcel of land situate in what was formerly the Town of Elm Grove, now in the City of Wheeling, Triadelphia District, Ohio County, West Virginia, and more particularly described as Lot Number 29, as same is shown and designated on the amended and revised plat of Elm Heights, of Elm Grove, made by C. C. Smith, Engineer, dated August 12, 1909, and recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Plat Book No. 1, at page 174, to which reference is hereby made, together with the buildings and appurtenances thereon and thereunto belonging, underlying coal was previously excepted.
This conveyance is made subject to exceptions, reservations, restrictions, covenants, conditions, easements and rights- of-way referred to or contained in this Deed, any aforementioned deeds and all prior conveyances of record.
Being the same property which was heretofore conveyed to Kyle T. Doyle and Carol Doyle, husband and wife, by Hilary Richardson by a Deed dated the 27th day of April, 2006, and recorded in the aforesaid County Clerk’s office in Deed Book No. 768, at page 134.
TERMS OF SALE: Sale of the Property will be made subject to the lien for any and all real estate taxes, whether or not currently due, owing, delinquent or payable, whether paid or are otherwise not currently payable; and further, sale of the subject interest in the Property is subject to any and all other liens, encumbrances, or adverse claims of interest which may be superior to the lien of the Deed of Trust being foreclosed upon or the title of Trustee hereunder. The Property will be conveyed “As Is”, without warranty or representation, express or implied, as to title, physical condition, environmental condition or any other adverse condition which might affect merchantability, marketability, fitness or use of the Property. CASH IN HAND or CERTIFIED FUNDS (Certified Check) in full in the amount of the successful bid or bids on the day of the sale is required for any bidder to purchase the subject Property.
