NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated September 13, 2006, executed by Borrowers, James G. Martin and Pamela Martin, to Richard Pill, the Trustee of record in the office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5023, at Page 9126 and re-recorded in Deed of Trust Book 5033, at Page 9858. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 200 Glenn Avenue, Beckley, WV 25801-4110. Pill & Pill, PLLC was appointed as Substitute Trustee by APPOINTMENT OF SUCCESSOR TRUSTEE dated November 23, 2016, of record in the Clerk’s Office in Book 5064, Page 5050. The borrowers defaulted under the Note and Deed of Trust and the Substitute Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Raleigh County, in Beckley, West Virginia, on the following date:
August 6, 2019 at 1:04 p.m.

A tract or parcel of land being Lot C, which is a part of Lots 92 and 93 of the Bowling Addition, situate in the City of Beckley, Raleigh County, West Virginia, and being more particularly described as follows:
BEGINNING at a 2-inch steel pipe, found, on the line of Lot 94, said pipe being a common corner of Lots A and C; thence leaving said Lot A and with said Lot 94 N 82deg. 00′ E. 60.00 feet to a point, on the western right of way line of Glenn Avenue, said point being a common corner of Lots 94 and C and also being S 82deg. 00deg. W 0.48 feet Front a 1-inch steel pipe, found; thence leaving said Lot. 94 and with said right of way line of Glenn Avenue S 08′ 00′ F 100.00 feet to a point, at the intersection of the western right of way line of Glenn Avenue and the northern right of way line of Avon Street, said point being S 19′ 53′ E 0.24 feet from a 3/4-inch steel pipe, found; thence leaving said right of way line of Glenn Avenue and with said right of way line of Avon Street S 82deg. 00′ W 60.00 feet to a point, said point being a common corner of Lots B and C and also being N 08deg. 00′ W 0.49 feet from a 1-inch steel pipe, found; thence leaving said right of way line of Avon Street and with said Lot B N 08′ 00′ W 100.00 feet (passing a common comer of Lots A and B at a distance of 52.00 feet and continuing with Lot A) to the point of beginning and containing 6,000 square feet (0.138 acres), more or less as surveyed by Eastern Surveying, Inc., in June, 1997 and shown on a plat attached hereto and made a part of this description.

And being, the same property acquired by James Martin and Pamela Martin, his wife, by deed dated September 13, 2006 from Christopher M. Daniels recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Deed Book 5023, at page 9124.

TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
