NOTICE OF TRUSTEE SALE
Notice is hereby given that by virtue of that certain Deed of Trust dated May 24, 2014 executed by John H. Douglas, III and Erika B. Douglas, unto J. Michael Anderson, Substitute Trustee, of record in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Trust Deed Book 731 at Page 537, the makers of the Note and obligation secured thereby having failed to pay the same as provided for under the terms of said Note and Deed of Trust, and default not cured within the terms of said note and Deed of Trust, the holder of the Note having declared the whole thereof to be due and payable and having requested the undersigned, in writing, to make sale of the real estate described in said Deed of Trust, I will sell at public auction to the highest bidder on August 9, 2019, at 9:30 a.m. of that day at the front door of the Courthouse of Greenbrier County, Lewisburg, West Virginia, the following described real estate, to-wit:
All that certain lot, tract or parcel of land, together with the buildings thereon, situate in White Sulphur Springs Municipality, Greenbrier County, West Virginia, near the intersection of Spruce Street and Elm Streets, and being more particularly described as follows:
Lot No. 4 of Summer Elms
Beginning at a point being the southeastern corner of Lot 4, said point is located North 67° 13’13” West 19.13 feet from a 3/4” reinforcing rod found at the intersection of the western right of way limits of Spruce Street and the northern right of way limits of Elm Street; thence with four new division lines through the lands of Almost Heaven Habitat for Hunamity, Inc., (Tax Map 16, Parcel 24, Deed Book 537, Page 620)
South 57° 08’21” West 48.00 feet to a point; thence
North 32° 51’37” West 30.00 feet to a point; thence
North 57° 08’21” East 48.00 feet to a point; thence
South 32° 51’37” East 30.00 feet to the beginning containing 0.033 acres, more or less.
The above described parcel is shown as Lot 4 on a plat of “Summer Elms” a Common Interest Community, dated March 30, 2012, and recorded in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia in record of Maps Book No.5, Cabinet D-116.
There is also hereby granted and conveyed a non-exclusive easement and right of way as shown, designated and illustrated on the aforesaid plat of “Summer Elms,”
And being the same real property conveyed unto John H. Douglas, III and Erika B. Douglas, by deed dated May 28, 2014 from Almost Heaven Habitat for Humanity, Inc., a West Virginia non-profit corporation, and of record in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia in Deed Book 566 at Page 229.
Reference is hereby made to all prior instruments in the chain of title for all prior reservations, restrictions, limitations, easements, and rights of way affecting the property herein conveyed.
TERMS OF SALE: Cash in hand paid on day of sale subject to all unpaid property taxes, restrictive covenants, reservations, and easements.
