NOTICE OF TRUSTEE SALE Pursuant to the authority vested by Deed of Trust dated the 1st day of August, 2012, Julian Tucker and Quincy Johnson, Grantors, to P. Andrew Vallandingham and Samuel Vallandingham, Trustees, which said Deed of Trust is of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Trust Deed Book 2471 beginning at page 586, and the undersigned, Daniel T Yon and Ralph J. Hagy, substituted Trustees, by Substitution of Trustees of record in the office of the Clerk of the County Commission of Cabell County in Trust Deed Book 401 at page 292 having been requested to do so by the Lender, and default having been made under the terms and conditions of said Deed of Trust, and the provisions of said Deed of Trust concerning acceleration having been complied with by the Lender and present holder of the note, said substituted Trustees shall sell at public auction on November 7, 2019 at 11:00 a.m. at the front steps of the courthouse of Cabell County, West Virginia, the following real estate more particularly described as follows: All that certain lot, piece or parcel of land situated in the City of Huntington, Cabell County, West Virginia, known and designated as shown on a map of Hensley & Noel’s Subdivision of part of Out Lot No. 335 as shown on a revised map of the City of Huntington, made by L.W. Leete and filed on the 31st day of December, 1903, in the Office of the Clerk of Cabell County, West Virginia, said map of Hensley & Noel’s Subdivision being recorded in Deed Book 87 at page 526 in the aforesaid Clerk’s Office, as LOT NUMBER FOUR (4) and being more particularly described as follows: BEGINNING at a point in the East line of 18th Street at the corner between Lots 3 and 4; thence with the East line of 18th Street in a southerly direction 30.24 feet to a point; thence with the line between Lots 4 and 5 in an easterly direction 183.18 feet to a point in the West line of a 15 foot alley; thence with said alley line in a northerly direction 30.00 feet to a point; thence with the line between Lots 3 and 4 in a westerly direction 179.10 feet to the place of BEGINNING, as shown on the Plat attached to that certain deed executed by Homer T. Zimmerman et ux, to Rodney D. Wyrick and Rhonda L. Wyrick, husband and wife, and their survivor, dated August 3, 1979 and recorded in the aforesaid Clerk’s Office in Deed Book 803 at page 254. TERMS OF SALE: Ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of total bid amount cash in hand on day of sale. Remainder due within 30 days from date of Trustee Sale. Payment for unpaid real estate taxes to be assumed by the purchaser. Subject to any and all assessments and taxes against said property, and all prior liens and encumbrances of any nature whatsoever. The purchaser shall be responsible for the payment of the transfer taxes imposed by Article 2 of Chapter 11 of the West Virginia Code. Any sale hereunder may be adjourned from time to time without any notice other than the oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Subject to the right of the Internal Revenue Service to redeem the property as provided by Section 7425 of the Internal Revenue Code, as amended.
