UNDER DEED OF TRUST
Notice is hereby given that, under authority of a certain deed of trust hereinafter described, the undersigned Trustee will, at the front door of the Tucker County Courthouse, in Parsons, West Virginia, on
November 6, 2019
11:00 a.m.
offer for sale certain property described in that certain deed of trust executed by JOSEPH D. UFFMAN and KARA UFFMAN to JENNIFER L. MORGAN and MATTHEW E. OSBORNE, as Trustees, which deed of trust is dated the 17th day of June, 2015, and of record in the Office of the Clerk of the County Commission of Tucker County, West Virginia, in Trust Deed Book 273, at Page 72; and given to secure CITIZENS BANK OF WEST VIRGINIA, the payment of a note therein described, and which said property is described as follows:
A tract or parcel of real estate, together with the improvements thereon and appurtenances thereunto belonging and the rights incidental thereto, situated in Clover District, Tucker County, West Virginia, lying southwest of WV Secondary Route 17, Mt. Zion Road, being more particularly bounded and described as follows:
Beginning at a set 5/8” rebar with cap, said rebar bears S. 43° 37’ 47” W. 336.19 ft. from a found 5/8” rebar, common corner to Poling, DB 80/417 and common corner to Helmick, DB 151/309; thence S 06° 12’ 00” W. 553.87’ traveling into Godwin (reserved), DB 93/309, to a set 5/8” rebar with cap, said rebar bears S 52° 53’ 09” W 280.83 ft. from a found W’ rebar, common corner to Nestor, DB 101/598 and common corner to Helmick, DB 151/309; thence N 83° 48’ 00” W 393.24’ traveling with a line crossing a gravel road, to a set 5/8” rebar with cap; thence N 06° 12’ 00” E 553.87’ traveling to a set 5/8” rebar with cap; thence S 83° 48’ 00” E. 393.24’ continuing into Godwin (reserved), DB 93/309, crossing a gravel road, to the beginning. Containing 5.00 acres, more or less, as surveyed by Kenneth Kelly, Professional Surveyor No. 973, of Dailey, West Virginia.
And being the same tract or parcel of real estate conveyed to the Grantors herein by Vanderbilt Mortgage and Finance, Inc., a Tennessee corporation, by deed dated the 11th day of June, 2015, and of record in the Office of the Clerk of the County Commission of Tucker County, West Virginia, in Deed Book 218 at page 288.
There is further hereby· conveyed “that certain road, referred to as Rebel Road, which begins at County Route 17 in Tucker County, West Virginia, near the Mt. Zion Church and traverses through Tracts 1, 2 and 3 and services the five (5) acre tract located on Tract 2”, as set forth in an Order of the Circuit Court of Tucker County, West Virginia entered April 23, 2015, and of record in said Clerk’s Office in Deed Book 217, at Page 663 and as depicted on a plat of record in said Clerk’s Office in Plat Cabinet 2, Slide 457.
This conveyance is made subject to the agreement pertaining to said right-of-way, as set forth in the above-referenced Order of the Circuit Court of Tucker County, West Virginia, of record in said Clerk’s Office in Deed Book 217, at Page 663. Said Order states that “the owners, their heirs and assigns of any buildings or residences located on Tracts 1, 2 and 3, and the five (5) acre tract, shall proportionally maintain the right of way and share such costs associated with the maintenance of such road, and the parties shall cooperate with each other to maintain such right of way. Such maintenance shall consist of grade and occasional gravel.”
This conveyance is made subject to any and all reservations, restrictions, exceptions, rights-of-way and made subject to any and all easements as set forth in prior instruments of record in the chain of title to said real estate.

This conveyance is made subject to any and all reservations, restrictions, exceptions, rights-of-way and easements as set forth in prior instruments of record in the chain of title to said real estate.
The above described property will be sold subject to all reservations, restrictions, exceptions and conditions contained in all prior deeds conveying said real estate except those pertaining to race, color or creed, and subject to all unpaid levies and assessments including real estate taxes.
TERMS OF SALE: Cash in hand on day of sale, or ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c} down), or approved line of credit with closing to occur within thirty (30) days. Purchaser accepts subject real estate “AS IS”.
The undersigned Substitute Trustee reserves the right to reject any and all bids received, and to continue said sale from time to time, upon announcement thereof given verbally, on day of sale and any continuance thereof.
