NOTICE OF FILING AND HEARING
On October 11, 2019, the Monongahela Power Company (Mon Power) and The Potomac Edison Company (PE) (jointly Companies) filed a proposed termination of a PURPA power purchase contract between Morgantown Energy Associates and Mon Power. The proposed termination date of the power purchase contract would be January 1, 2020. To terminate the contract, the Companies will pay $60 million which the Companies seek to recover through ENEC rates starting January 1, 2020. The Companies allege that termination of that contract will result in a forecasted reduction in 2020 power purchase costs of $17,685,623 and additional amounts thereafter. The proposed rate impact of the termination of the contract starting January 1, 2020 will be an increase in rates of $6,117,651 over the rates originally proposed in Case No. 19-0785-E-ENEC. When coupled with the originally proposed rate decrease of $6,117,651 in the Companies ENEC proceeding, the net impact to ratepayers January 1, 2020 will be a zero change in rates.
The Companies will file their direct testimony in Case No. 19-1028-E-PC on November 12, 20 I 9. Other parties shall file their direct testimony in this matter on or before December 3, 2019, with rebuttal testimony of any party due December 9, 2019. This matter is scheduled for an evidentiary hearing on Wednesday, December 11, 2019, beginning at 9:30 a.m. in the Howard M. Cunningham Hearing Room, Public Service Commission, 201 Brooks Street, Charleston, West Virginia. Interested persons may attend the hearing and make public comment. The hearing can also be viewed on the internet by accessing the hearing webcast at http://www.ps c.state.wv.us/webcase/default.htm.
Additionally, the hearing in Case No. 19-0785-E-ENEC, previously scheduled for November 15, 2019, will now be held on Wednesday, December 11, 2019, beginning at 9:30 a.m. in the Howard M. Cunningham Hearing Room, Public Service Commission, 201 Brooks Street, Charleston, West Virginia. Case No. 19-0785-E-ENEC will be heard first followed immediately by Case No. 19-1028-E-PC. The cases are being heard on the same day because the issues in the two cases are related.
Anyone desiring to petition to intervene should file a written petition within thirty days following the publication of this notice. Failure to timely seek to intervene can affect your rights to participate in future proceedings. The Commission will receive written comments or protests up to the date of hearing. All protests or requests to intervene should briefly state the reason for the protest or intervention. Requests to intervene must comply with the Commission Rules of Practice and Procedure, 150 C.S.R. 1.
