NOTICE OF SUCCESSOR TRUSTEE’S SALE Notice is hereby given, by virtue of the authority vested in the undersigned Successor Trustees, Eric M. Johnson and R. Douglas Calderwood, by that certain Deed of Trust made by James Porter and David A. Porter, dated February 18, 2016 and recorded February 25, 2016 in the office of the Clerk of the County Commission of Kanawha County, West Virginia in Trust Deed Book 4155 at page 685, the said Successor Trustees acting by virtue of that certain Appointment of Successor Trustee dated September 27, 2019 and recorded October 2, 2019 in the aforesaid Clerk’s office in Trust Deed Book 4385, at page 748, and default having been made in the payment of the Note secured by the aforesaid Deed of Trust, and having been requested in writing by the owner and holder of the Note, will offer for sale, at public auction, to the highest bidder at the front door of the Courthouse of Kanawha County, West Virginia, on December 4, 2019 at 10:15 a.m., all that certain lot, piece or parcel of real property, together with improvements thereon, situate in Charleston, Charleston 15th Ward District, Kanawha County, West Virginia, being more particularly bounded and described as follows: All that certain lot or parcel of land, situate in the City of Charleston, 15th Ward, Kanawha County, West Virginia, and being known and designated as Lot No. “AA” upon that certain map or plat entitled, “Map Showing Resubdivision of Part of Lots Nos. 1, 2, 3 & un-numbered Lot East of Lot No. 1 & All of Lots “U”, “V” & “W” of the B. F. Porter Estate, Located in the City of Charleston, W.Va., Owned by James G. Porter et al, Scale 1″ 30′, July 25, 1980, made by Field Engineering Co.”, said map being of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, the said Lot No. “AA” being more particularly bounded and described as follows: BEGINNING at a “point on wall” in the southerly line of Porter Road, near its intersection with Callie Road, said point being also the front common corner of Lot No. “AA” and the property owned by Marvin McDaniel, as shown upon the said map; thence with the line of Porter Road, S 88 54′ E 74.93 feet to a “point on a wall”, being also the common front corner of Lots Nos. “AA” and “BB” as shown upon the said map; thence leaving Porter Road and running S 4 06′ 30″ W 120.00 feet to a stake in the rear with the common corner of Lots Nos. “AA” and “BB” as shown upon the said map; thence running with the common lines of Lots Nos. “AA”, “CC” and “DD”, N 87 52′ 30″ W 99.96 feet to a stake in the line of the said McDaniel Property; thence with the common division line between Lot No. “AA” and the McDaniel property N 4 06′ 30″ E 104.35 feet to the point of beginning, containing 12,054.80 square feet, more or less. Also granted and conveyed is the right to cross over and utilize the right of way situate on adjacent Lot “BB” to provide ingress and egress to and from Lot “AA”. Being the same property conveyed unto James Guy Porter, Sharon Lynn Porter and David Alan Porter by Abby H. Porter by two deeds; the first of which is dated December 29, 1975 of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 1781, page 449; and the second deed dated March 10, 1976, of record in the aforesaid Clerk’s Office in Deed Book 1789, page 428; the said Sharon Lynn Porter Shull and Bruce E. Shull, her husband, conveyed their interest in said property to James Guy Porter and David Alan Porter by deed dated July 14, 1980, of record in the aforesaid Clerk’s Office in Deed Book 1949, page 397. At the time of execution of the deed of trust, the grantor represented that the address of the property was 1371 1374 Callie Road, Charleston, WV 25314. TERMS OF SALE: The Premises will be sold “AS IS, WHERE IS,” in its present condition and with all faults and defects, if any. The property will be conveyed by deed with no covenants of warranty of title. The property shall be sold subject to all liens not discharged by the sale, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges and liens with priority to the Deed of Trust pursuant to which this sale is being conducted. The property shall be sold subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s office or visible upon the ground. The property will be sold for cash in hand on the date of sale to the highest bidder. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamps to be affixed to the deed). The Successor Trustees and WesBanco Bank, Inc. shall not be responsible for the removal of any person or personal property from the Premises. Pursuant to the Deed of Trust, the Successor Trustees may postpone the sale by public announcement at the time and place designated and act by agent in the execution of the sale.
