By virtue of that certain Deed of Trust made by Michelle D. Robinson to John E. Gompers, Trustee, dated the 7th day of May, 2018, and of record in the office of the Clerk of the County Commission of Marshall County, West Virginia, in Deed of Trust Book No. 1019, at page 237, and that certain Appointment of Successor Trustee, dated the 7th day of October, 2019, and of record in the aforesaid County Clerk’s office in Deed of Trust Book No. 1050, at page 473, the undersigned will sell at public auction, and subject to the terms and conditions set forth in this Trustee’s Notice of Sale and in the said Deed of Trust, on the 21st day of November, 2019, at 10:00 o’clock A.M., at the front door of the Marshall County Courthouse, Moundsville, West Virginia, the following described property (“Property”) situate at 1028 Morton Avenue, Moundsville, Marshall County, West Virginia 26041, and more particularly described as follows:
The following described two (2) certain lots or parcels with the address of 1028 Morton Avenue, situate in the City of Moundsville, Mdsv. Corp. District, Marshall County, West Virginia, and now shown on Tax Map 21, as Parcel No. 0033 0000 1100, that is to say:
FIRST: Lot Number Seven (7) in J. R. Logan’s Addition to the City of Moundsville, Marshall County, West Virginia, a Plat of which said Addition is of record in the Office of the Clerk of the County Commission of Marshall County, West Virginia, in Deed Book 76, page 214; which said Lot fronts thirty-five (35) feet on the East side of Morton Avenue in said City, and extends back, with equal width, one hundred two (102) feet to an alley, and is bounded on the North by a ten (10) foot alley.
SECOND: Five (5) feet off of the North side of Lot Number Eight (8) in said J. R. Logan’s Addition to the City of Moundsville, Marshall County, West Virginia, and extending back, with an equal uniform width, a distance of one hundred two (102) feet, to an alley.
It is intended by this Deed to grant and convey a certain parcel of ground fronting forty (40) feet in width on the East side of Morton Avenue in said City, and extending back for a depth of one hundred two (102) feet to an alley.
This conveyance is, however, subject to the exceptions, reservations, covenants, conditions, restrictions and easements, if any, granted by or acquired from the parties of the first part and their predecessors in title to said land.
Being the same property conveyed to Michael D. Robinson and Michelle D. Robinson from Christopher A. Riedel and Lisa D. Riedel (formerly known as Lisa D. Whipkey) by Deed dated July 30, 1998, and recorded in the office of the Clerk of the County Commission of Marshall County, West Virginia, in Deed Book 603, at page 65. The said Michael D. Robinson conveyed his interest in the subject property to Michelle D. Robinson by Deed dated September 8, 2004, and recorded in the office of the Clerk of the County Commission of Marshall County, West Virginia, in deed Book 641, at page 365.
TERMS OF SALE: Sale of the Property will be made subject to the lien for any and all real estate taxes, whether or not currently due, owing, delinquent or payable, whether paid or are otherwise not currently payable; and further, sale of the subject interest in the Property is subject to any and all other liens, encumbrances, or adverse claims of interest which may be superior to the lien of the Deed of Trust being foreclosed upon or the title of Trustee hereunder. The Property will be conveyed “As Is”, without warranty or representation, express or implied, as to title, physical condition, environmental condition or any other adverse condition which might affect merchantability, marketability, fitness or use of the Property. CASH IN HAND or CERTIFIED FUNDS (Certified Check) in full in the amount of the successful bid or bids on the day of the sale is required for any bidder to purchase the subject Property.
