COMMISSIONER’S
SALE PUBLIC AUCTION
In execution of an Order entered on September 23, 2019, signed by the Honorable Paul M. Blake, Jr., Judge in the Circuit Court of Fayette County, West Virginia, said Order appointing Paul O. Clay, Jr., as Special Commissioner to sell the subject real estate at Public Auction on the front steps of the Fayette County Courthouse, on Tuesday, December 3, 2019 at 10:30 a.m., the following tract of real estate situate in Fayette County, West Virginia, and being more particularly bounded and described as follows:
Beginning at a 5/8″ capped rebar (set) on one line of the Earnest Johnson tract (WB 72, page 418) and corner to Benjamin Johnson Sr. et al (DB 615, page 367) and the French and Janice Adkins tract (DB 540, page 106), of which this is a part; thence leaving Johnson and with Benjamin Adkins, Sr. in part S 2300’00” W a distance of 332.86′ to a PK nail (set) within the French Adkins tract, thence continuing through Adkins following near a cliff line for the following two courses and distances, S 5534’13” W for a distance of 103.37′ to a point on the edge of the top of said cliff; thence S 1413’10” W for a distance of 55.90′ to a point at the base of an old post on top of said cliff on the division line between Adkins and Holly Thompson (DB 604, page 13); thence with said division line for the following three courses and distances N 6939’54” W a distance of 3.84′; thence N 8900’00” W a distance of 48.00′; thence N 7245’00” W a distance of 74.00′ to a 5/8″ capped rebar (set) corner to a 3.014 acre tract of land owned by David B. Dixon; thence leaving Thompson and with Dixon N 0659’31” W a distance of 454.51′ 5/8″ capped rebar (now gone) on one line of Johnson; said point lies S 8200’00” E a distance of 316.12′ from a 4″ x 6″ set stone (found); thence with Johnson S 8200’00” E passing a 5/8″ rebar at 35.00′ for a total distance of 413.88′ to the point of beginning, having an area of 125328 square feet or 2.88 acres, as shown on the attached plat dated 04/02/14, prepared by R. Dale Tomlin, II, PS 2071. All bearings based on Deed Meridian (DB 540, page 106).
And being the same tract or parcel of real estate conveyed to David B. Dixon by deed of French L. Adkins and Janice Adkins, dated April 14, 2014, of record in the Office of the Clerk of the County Commission of Fayette County, West Virginia in Deed Book 712, at page 686.
The above described real estate will be conveyed by the undersigned Special Commissioner to the purchaser thereof by deed containing a covenant of SPECIAL WARRANTY and subject to all liens, reservations and exceptions appearing in the record title and without survey.
TERMS OF SALE: Cash on hand on day of sale.
The above described real estate will be sold by the undersigned Special Commissioner by auction to the highest bidder subject to the right of the Special Commissioner to reject all bids if in his opinion they are inadequate.
CONTINUANCE OR ADJOURNMENT OF SALE: The Special Commissioner reserves the right to continue the sale, or to adjourn the sale, for a time, or from time to time, without further notice and announcement at the time and place of sale, as hereinabove set forth, or any continuance or adjournment thereof.
