Dolin, Eugenia Lee Carnes, Robert R. Tuner, Larry A. Turner, Glen L. Greene, Mary Audell Greene Heirs, Debra D. Icenogle, Shirley J. Duncan, David Mark Greene, Robin Dawn Greene, Brenda Greene Alonso, Richard D. Strealy, Lowell Lionel Greene, II Heirs, Stephanie Smith Lester, Unknown Persons/Owners, and Randall White, Sheriff of Boone County, West Virginia (hereinafter sometimes referred to as “the aforementioned respondents”), that, pursuant to W. Va. Code 54-1-1, et seq. and 54-2-1, et seq., and all applicable West Virginia Statutes, a just compensation hearing will be held on December 19, 2019, at 1:30 p.m., in this action in the Circuit Court of Boone County, West Virginia, before Judge William S. Thompson to determine just compensation in relation to a Petition for Condemnation/Right of Entry, which was filed and granted in the Circuit Court of Boone County, West Virginia, and is known as Civil Action No. 19-C-89, and styled Appalachian Power Company v. James Lee Greene, et al. An Order of Right of Entry was entered on October 21, 2019, in the records of the Circuit Clerk of Boone County, West Virginia. Said just compensation hearing will address real property for the construction of electrical transmission, distribution, and communication lines and appurtenant equipment and fixtures, and condemnation and right of entry on behalf of Appalachian Power Company situate in Washington District, Boone County, West Virginia, identified as Tax Map 29, Parcel 21, and recorded in the office of the Clerk of the County Commission of Boone County, West Virginia, in Deed Book 27, at page 201, and being more particularly described as follows: 50.52 SF., SPRUCE FK Being Tract No. 4 in the aforesaid partition, containing 51.89 acres; that is to say; BEGINNING: – On a stake in the West right of way line of the C & O Railway Co. a corner of lot no. 1 thence with Lot No. 1 S. 53 12 W. 300.0 feet To a stake on the East Bank of a branch thence, S. 58 36 W. 1960.0 feet To a Chestnut oak thence leaving Lot No. 1 S. 58 03 W. 1567.5 feet To a stake thence N. 52 15 W. 112.2 feet To a chestnut oak, thence, N. 59 15 W. 214.5 feet To 2 chestnut oaks thence, N. 52 15 W. 256.7 feet To a down locust thence, N. 52 45 W. 335.2 feet To 2 chestnut oaks a corner of lot No. 5 thence withLot No. 5, N. 66 39 E. 4218.0 feet Crossing the railroad to a stake in the East right of way line of the C & O Railway Co. thence, N. 42 09 E. 211.0 feet To a Stake on the bank of the old public road thence up the road, S. 53 44 E. 225.0 feet To a Stake the North West corner of reserved road thence with the reserved road, S. 41 11 W. 229.0 feet To a Stake in the East Right of way line of the C & O Railway Co. thence with the East right of way line and crossing the reserved road, S. 47 15 E. 15.5 feet To a Stake a corner of Lot No. 3 thence leaving Lot No. 3 and crossing the railroad. S. 11 45 W. 75.0 feet To the beginning containing 51.89 acres there is excepted out of this tract the right of way of the C & O Railway Co. acreage deducted. The aforementioned respondents are hereby notified a copy of said Petition for Condemnation/ Right of Entry and Order of Right of Entry may be obtained from the Boone County Circuit Clerk’s office at Boone County Courthouse, 200 State Street, Madison, West Virginia, 25130, for the purposes of appearing and defending. The Petition for Condemnation/ Right of Entry and Order of Right of Entry may also be obtained from the attorneys for Appalachian Power Company, Stephen F. Gandee, Post Office Box 128, 140 West Main Street, Suite 300, Clarksburg, West Virginia, 26302-0128, or Douglas C. McElwee, 700 Virginia Street East, Suite 400, Charleston, West Virginia, 25301. The aforementioned respondents are further notified that, at the said hearing to determine just compensation on December 19, 2019, at 1:30 p.m., in the Circuit Court of Boone County, West Virginia, located at Boone County Courthouse, 200 State Street, Madison, West Virginia, 25130, before the Honorable William S. Thompson, you may appear for hearing and presentation of evidence, and are notified that any failure to appear and/or present evidence may result in the waiver of any defenses or claims, if any, you may have regarding just compensation or otherwise in this action.
