NOTICE OF TRUSTEE’S SALE

NOTICE IS HEREBY GIVEN that by virtue of that certain Credit Line Deed of Trust dated February 27, 2014, executed by P & H Industries, Inc., to Stephen M. Feola and Gary R. Mills, Trustees, of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Trust Deed Book 5054, at page 4890, David M. Kersey having been substituted as Trustee pursuant to Substitution of Trustee of record in the aforesaid Clerk’s office in Trust Deed Book 5070, at page 6575, default having occurred in payment of the indebtedness secured by said Credit Line Deed of Trust, and the undersigned Substitute Trustee having been requested to do so by First Community Bank, owner and holder of the indebtedness secured by said Deed of Trust, the undersigned Substitute Trustee will offer for sale and sell at public auction on January 3, 2020, at 11:15 a.m., at the front entrance to the Raleigh County Courthouse, 215 Main Street, Beckley, Raleigh County, West Virginia, the following described real estate, together with the improvements thereon and appurtenances thereunto belonging, more particularly bounded and described as follows:
That certain lot or parcel of land situate near the City of Beckley, in Town District, Raleigh County, West Virginia, and more particularly described as follows:
TRACT NO. B:
BEGINNING at a set PK Nail, said point being on the right-of-way of Eisenhower Drive (50′ R/W) and on Lot 8 of the Lilly Land Addition, thence leaving said Eisenhower Dr. R/W and through said Lot 8; N 50deg. 02′ E. 10.82 feet to a set PK Nail, thence continuing through said Lot 8; N 30deg. 41′ W, 78.74 feet to a set 5/8″ rebar, said point of being on Lot 9, thence continuing through Lot 9; N 13deg. 16′ 169.50 feet to a set 5/8″ rebar, said point being on the Right-of-Way of Cuthrill St. (40′ R/W) and on the line of Lot 12, thence with said R/W and said Lot 12; S 72deg. 30′ E. 241.87 feet to a set 58″ rebar, said point being a corner to Lot 24 and on the Right-of-Way of Larew Avenue (40′ R/W), thence leaving aforesaid Cuthrill St. and with said Larew Ave. and Lot 24; S 17deg. 30′ W 150.0 feet to a set 5/8″ rebar, said point being a corner to Lots 21 and 22; thence leaving aforesaid Larew R/W and with the common line of Lots 21 and 22; N 72deg. 30′ W 101.34 feet to a fence post, thence leaving aforesaid Lot 21; S 50deg. 02′ W. 112.29 feet to a set PK nail, said point being on the Right-of-Way of aforesaid Eisenhower Dr., thence with said R/W; N 29 02′ W, 20.37 feet to the point of BEGINNING AND CONTAINING 0.98 ACRE, MORE OF LESS consisting of part of Lots 8, 9, 10, 11, 12, 20, 21, Lots 23 and 24 Section 21 of the said Addition.

The Seller does impose on Tract B a permanent easement to Tract A through Tract B by way of the asphalt driveway to the retaining wall to inspect and repair the marked retaining wall located on Tract A. The Owner of Tract A has by Deed accepted responsibility for maintenance of retraining wall in a manner to not interfere with the use of or damage Tract B.
TERMS OF SALE: Ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) cash in hand on day of sale and balance upon delivery of deed. Sale subject to any and all real property taxes or assessments due or to become due, all applicable subdivision and zoning restrictions, matters of survey, compliance with environmental regulations, rights of tenants in possession, if any, and all other pertinent liens, easements, restrictions and reservations of record. The property is sold in an “as is” condition. The purchaser shall pay the excise tax on the transfer of real estate. Any personal property remaining on the premises at the time of sale shall be considered abandoned. The undersigned trustee reserves the right to reject any and all bids, the right to continue the sale by announcement on the date of the sale and the right to announce other conditions upon the sale, which announced conditions, if any, shall be in addition to or take priority over any conditions set forth herein.
