SUBSTITUTE TRUSTEE’S SALE OF VALUABLE REAL ESTATE

Notice is hereby given that the undersigned Substitute Trustee, appointed by document dated November 18, 2019, and of record in the Office of the Clerk of the Marshall County Commission in Deed of Trust Book 1052, at page 109, will sell at public auction to the highest bidder on:
January 3, 2020,
at 10:00 a.m.,
at the front door of the Marshall County Courthouse, 600 7th Street, Moundsville, West Virginia, that certain property conveyed by Anne C. Klem (n/k/a Anne C. Aalmo) to Ronal W. Rush, Trustee, by Deed of Trust dated December 21, 2004, and recorded in the office of the said Clerk of the County Commission of Marshall County, West Virginia, in Deed of Trust Book 742, at page 157, and being described as follows:
Beginning at a corner to parcel conveyed to David Wingrove by George A. Wolfe and wife by deed bearing date the 28th day of February, 1925, and recorded in the Office of the Clerk of the County Commission of Marshall County, West Virginia, in Deed Book 178, at page 570, said corner being witnessed by a mulberry; thence with the line of said Wingrove S. 33 1/2* E. 132 feet; thence along side of proposed road N. 14 3/4* E. 175 feet to a stake corner to David Wingrove and Hiram Toler; thence N. 72* 50′ W. 450 feet to county road; thence with county road right of way S. 7 1/4* E. 231 1/2 feet to corner of Wingrove (first parcel mentioned above conveyed by deed dated February 28, 1925); thence with Wingrove line to place of beginning, containing 1.4 acres, more or less, according to survey of F. W. Parsons dated June 3, 1925.
Being the same property conveyed to Jams D. Klem and Jane A. Klem, his wife, from Joseph John Kramer and Jo Ann Kramer, his wife, by Deed dated September 29, 1978, and of record in Marshall County Deed Book 475, page 515. The said Jane A. Klem conveyed her interest in the subject property to James D. Klem by Deed dated October 20, 1984, and of record in Marshall County Deed Book Deed Book 514, page 435. The said James D. Klem died testate on February 6, 1994, and by his Last Will and Testament, dated April 7, 1987, and of record in Marshall County Will Book 59, at page 264, he devised the subject property to Anne C. Klem (n/k/a Anne C. Aalmo).

The terms of the sale will be as follows: Cash in hand on the day of sale. Sale of said property will be made subject to: (1) All prior exceptions, reservations, rights of way, easements, conditions, covenants, restrictions, leases and other servitudes of record if any pertaining to said real estate; (2) any and all unpaid taxes assessed against said property; (3) the subject property will be sold in “as is” condition; (4) the Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property; (5) the Substitute Trustee will deliver a Substitute Trustee’s Deed to the purchaser without any covenant or warranty (expressed or implied) in the form prescribed by West Virginia Code Chapter 38-1-6. The Substitute Trustee makes no representations and warranties about the title of the real estate to be conveyed.
Any sale hereunder may be adjourned from time to time without notice other than oral proclamation at the time and place appointed for the sale.
The Substitute Trustee reserves the right to reject any or all bids. Additional terms and conditions shall be announced at the sale.
