NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated August 19, 2014, executed by Borrowers, John R Nutter and Nancy K Nutter, to Vance Golden, Attorney, the Trustee of record in the office of the Clerk of the County Commission of Fayette County, West Virginia, in Book 935, at Page 270. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 16298 Deep Water Mtn, Deep Water, WV 25057. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated October 9, 2019, of record in the Clerk’s Office in Book 1020, Page 611. The borrowers defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Fayette County, in Fayetteville, West Virginia, on the following date:

All those certain pieces or parcels of land, together with the improvements thereon and the appurtenances thereunto belonging, situate on the waters of Kanawha River at Deepwater, in Valley District, Fayette County, West Virginia, more particularly bounded and described as follows: PARCEL ONE: Beginning at a point at the southerly common corner of a 0.110 acre lot owned by Alma Jean Manley in Will Book 75, Page 309 and the parcel herein conveyed and on the northerly side of WV Route 61 or Deepwater Mountain Road, also referred to as the Giles Fayette and Kanawha Turnpike, thence N. 68-16 W. 48.50 feet to a point; thence N. 29-04-30 E. 10.33 feet, leaving the said road and running down the hill to the corner of the said 0.074 acre lot; thence N. 29-04-30 E. 78.72 feet, leaving the said road and running with the said 0.074 acre lot to a No. 5 rebar with cap set on the line of the Norfolk and Western Railroad; thence Ch. S. 88-39-E. 53.76 feet, leaving the said 0.074 acre lot and running with the said railroad in a curve to the right to a point at the common northerly corner between the aforementioned 0.110 acre lot and the property herein conveyed; thence S. 28-48 W. 107.86 feet, leaving the said railroad and running with the said 0.110 acre lot to the point of beginning, containing in all 0.109 acres, more or less, all as shown more fully on a map or plat entitled “PLAT SHOWING THREE PARCELS OF LAND AT DEEPWATER VALLEY DISTRICT, FAYETTE COUNTY, WEST VIRGINIA SURVEYED FOR ALMA JEAN MANLEY SCALE: 1″ = 40′ JUNE 24, 2010” as surveyed and mapped by William R. Gunnoe, Registered Professional Surveyor. PARCEL TWO: Beginning at a point at the southerly common corner of property owned by James O. & Mary Ann Hamrick in Deed Book 404, Page 673 and on the northerly side of WV Route 61 or Deepwater Mountain Road, also referred to as the Giles, Fayette and Kanawha Turnpike, thence N. 68-45 W., leaving the said Hamrick and running along said road passing a No. 5 rebar with cap set on line at 0.31 feet, in all 49.32 feet to a point at the southerly common corner between a 0.109 acre lot and the property hereby conveyed; thence N. 28-48 E. 107.86 feet, leaving the said road and running with the said 0.109 acre lot to a point on the line of the Norfolk and Western Railroad; thence Ch. S. 82-09 E. 38.38 feet, leaving the said 0.109 acre lot and running with the said railroad in a curve to the right to a No. 5 rebar with cap set at the common northerly corner between the property of Elouise R. Coleman in Deed Book 404, Page 298 and the property herein conveyed; thence S. 22-19-56 W. 115.84 feet, leaving the said railroad and running with the said Coleman, then the aforementioned Hamrick to the point of beginning, containing in all 0.110 acres, more or less, all as shown more fully on a map or plat entitled “PLAT SHOWING THREE PARCELS OF LAND AT DEEPWATER VALLEY DISTRICT, FAYETTE COUNTY, WEST VIRGINIA SURVEYED FOR ALMA JEAN MANLEY SCALE: 1″ = 40′ JUNE 24, 2010” as surveyed and mapped by William R. Gunnoe, Registered Professional Surveyor. This conveyance is made subject to those certain easements and rights of way as shown on that certain map entitled “PLAT SHOWING THREE PARCELS OF LAND AT DEEPWATER VALLEY DISTRICT, FAYETTE COUNTY, WEST VIRGINIA SURVEYED FOR ALMA JEAN MANLEY SCALE: 1″ = 40′ JUNE 24, 2010” as surveyed and mapped by William R. Gunnoe, Registered Professional Surveyor. PARCEL THREE: Beginning at a 6×6 concrete right of way monument found on the northerly side of WV Route 61 or Deepwater Mountain Road (also referred to as the Giles, Fayette and Kanawha Turnpike) and on the easterly side of Deepwater Station Road, thence N. 22-58 E. 22.03 feet, leaving the said Deepwater Mountain Road and running with the said Deepwater Station Road to another 6×6 concrete right of way monument found; thence N. 69-05-30 E.74.98 feet, running along the said Deepwater Station Road to a point in the southerly line of the Norfolk and Western Railroad; thence Ch. N. 86-30-30 E. 15.00 feet, running along the said railroad line to a No. 5 rebar with cap set at the northerly common corner of a 0.109 acre lot and the property herein conveyed; thence S. 29-04-30 W. 78.72 feet, leaving the said railroad and running with the said 0.109 acre lot to a point in the line of the aforementioned WV Route 61 or the Giles, Fayette and Kanawha Turnpike; thence N. 69-22 W. 59.16 feet, leaving the said 0.109 acre lot and running along the said road to the point of beginning, containing in all 0.074 acres, more or less, all as shown more fully on a map or plat entitled “PLAT SHOWING THREE PARCELS OF LAND AT DEEPWATER VALLEY DISTRICT, FAYETTE COUNTY, WEST VIRGINIA SURVEYED FOR ALMA JEAN MANLEY SCALE: 1″ = 40′ JUNE 24, 2010” as surveyed and mapped by William R. Gunnoe, Registered Professional Surveyor. The parcel of land herein described is that portion of the “storehouse lot” which remains after an out conveyance of a portion of the original lot to the West Virginia Department of Highways by Anna Elizabeth Hanning, widow, by deed dated the 14th day of May, 1986, of record in Deed Book 444, at Page 135. This conveyance is made subject to any and all covenants, restrictions, and easements as the same may appear in instruments of record in the aforesaid Clerk’s Office.

Being the same property conveyed to John R Nutter and Nancy K Nutter by the Deed dated July 30, 2014 and recorded in Deed Book 715 at Page 303 in the Office of the Clerk of the County Commission of Fayette County, West Virginia.

TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
