NOTICE OF TRUSTEE’S SALE Pursuant to the authority vested in the undersigned J. Patrick Jones, Substitute Trustee by Notice of Substitution of Trustee which notice is of record in the Office of the Clerk of the County of Commission of Wayne West Virginia, and by Deed of Trust dated September 29, 2017, executed by Belinda D. Cyrus and Patrick N. Cyrus to Richard A. Pill, Trustee, which deed of trust is of record in the Office of the Clerk of Wayne County, West Virginia, in Trust Deed Book 791 at Page 843, the undersigned Substitute Trustee has been requested, in writing, by the beneficiary of said deed of trust to sell the real estate described below, as there has been a default under the terms and conditions of said deed of trust. Therefore, the undersigned Substitute Trustee will sell the real estate described in the Deed of Trust, at a public auction on January 29, 2020 at 11:15 a.m. to the highest bidder at the front door of the Courthouse of said County of Wayne, in Wayne, West Virginia, which real estate is more completely described as follows: All those certain lots, pieces or parcels of real property situate in the Town of Prichard. Butler District. Wayne County. West Virginia, being more particularly bounded and described as follows: Known and designated on a certain Plat made by Jos. N. Doyle, Engineer for Smith and Beuhring. of the Lindsey Smith Farm, and known and designated on said Plat as a part of Lot No. Seventeen (17), and being more particularly bounded and described as follows: PARCEL NUMBER ONE (1): Beginning at the west corner of the Wiser Adkins property and running west along Ferry Road 100 feet to a stake; thence running north 165 feet to a property line; thence running along said property line 100 feet to Wiser Adkins property; thence running 153 feet along Wiser Adkins property to the Beginning and Ferry Road. PARCEL NUMBER TWO (2): Beginning at a stake on north right of way line of Ferry Street in Prichard, W. Va., corner to Jackie Christian’s lot, thence N. 20 E. 167 feet to a stake in an old fence line; thence with said fence line, N, 63 1/4 W. 50 feet to an iron stake; thence S. 20 W. 173 1/2 feet to an iron stake in north right of way line of said Ferry Street, and with same, S. 70 1/2 E. 50 feet to the Beginning, containing TWO TENTHS (.2) ACRE, more or less. The parties of the first part herein further grant and convey unto the, parties of the second part herein, their heirs and assigns, all interest they have in a right of way or easement for maintenance of a gas line, where the same now exists, being more particularly bounded and described as follows: Beginning at the corner of the lot herein conveyed nearest the main pipeline line; thence S. 63 1/4 E. 220 feet to the main pipeline, the said easement running four (4) feet inside the old fence line. PARCEL NUMBER THREE (3): THE WESTERLY TWENTY (20) FEET ONLY of the following described parcel of real property: BEGINNING at a stake set in the corner of Archie Luster line; thence in a northerly direction 138 feet to a stake set in the Otto Hatten line; thence in a westerly direction 154 feet to a stake in the line of Ferry Street; thence with the Ferry Street line in a southerly direction 140 feet to a stake set in the Archie Luther line; thence in an easterly direction 150 feet to the place of BEGINNING, and containing 21,128 square feet, more or less. TERMS OF SALE 1. Cash in hand paid on the day of sale. 2. The sale of the property will be made subject to all matters having priority over the deed of trust referred to herein including but not limited to any and all assessments and taxes against said property, all prior liens, encumbrances, lease, restrictions, covenants, conditions, rights of way and easements of any nature whatsoever. 3. The purchaser shall be responsible for the payment of the transfer taxes imposed by West Virginia Code 11-22-2. 4. The subject property will be sold in “AS IS” condition. The Substitute Trustee makes no representations and warranties of any kind or character including, but not limited to, the condition of the real estate or the title to the real estate to be conveyed. 5. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. 6. The Substitute Trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of the sale described above. 7. The beneficiary of the Deed of Trust and holder of the note thereby secured reserves the right to submit a bid for the property at the sale, which bid may be in the form of a credit bid. 8.
