NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated April 11, 2005, executed by Borrowers, Todd R. Barrie and Vicki D. Barrie, to James B. Crawford III, the Trustee of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book 3234, at Page 870. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 2934 Shadyside Drive, Saint Albans, WV 25177. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated November 21, 2018, of record in the Clerk’s Office in Book 4338, Page 223. The borrowers defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Kanawha County, in Charleston, West Virginia, on the following date: 25th day of February, 2020 at 10:30 a.m. All that certain lot, tract or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Jefferson District, Kanawha County, West Virginia, and being part of Parcel Five-A (5-A) of Riverlake Estates as shown upon a map thereof entitled, “Map Showing Part Of Parcel 5A Of River Lake Estates In Jefferson District, Kanawha Co., W. Va. To Be Conveyed To Harry C. Cannon & Nora K. Cannon”, dated March 26, 1962, made by Field Engineering Co., which map is of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia To Be Exchanged By River Lake Estates, Inc. And J.R. Aliff Et Al”, dated September 5, 1967, made by Field Engineering Co., which map is of record in the aforesaid Clerk’s Office in Map Book 23, at pages 2 and 3, said property hereby conveyed being more particularly bounded and described as follows: BEGINNING at an iron pin in the southerly right-of-way line of West Virginia State Secondary Route 6/4, (also known as Shadyside Road) which pin is located S. 64′ 57′ E. 200 feet from an old pin at the northeast corner of tract of land containing 1.8 acres conveyed to Burl A. Sawyers by J. R. Aliff and River Lake Estates, Inc., a corporation, by Deed dated September 3, 1954, recorded in the aforesaid Clerk’s Office in Deed Book 1135, at page 351, and which Sawyers Tract is shown on a map of River Lake Estates, recorded in the aforesaid Clerk’s Office in Deed Book 097, at page 294-A; thence leaving said beginning point and running with the said southerly line of West Virginia Secondary Route 6/4 (Shadyside Road) S. 64 57′ E. 80 feet to an iron pin in said line; thence leaving said Secondary Route 6/4 and running S. 25′ 03′ W. 200 feet to an iron pin; thence running N. 64′ 57′ W. 80 feet to an iron pin at the rear corner of a lot conveyed by River Lake Estates, Inc. to James C. Rutledge, Jr. and Mildred Wade Rutledge, his wife, by Deed dated March 12, 1962, recorded in the aforesaid Clerk’s Office in Deed Book 1355, at page 121; thence running with the easterly line of said Rutledge property N. 25′ 03′ E. 200 feet to the place of beginning. Subject to all of the restrictions, reservations, easements, exceptions and covenants as set out in that certain Deed from River Lake Estates, Inc., a corporation, to Harry C. Cannon and Nora K. Cannon, his wife, dated April 3, 1962, of record in the aforesaid Clerk’s Office in Deed Book 1358, at page 551. Being the same property conveyed to Todd R. Barrie and Vicki D. Barrie by the Deed dated April 11, 2005 and recorded in Deed Book 2627 at Page 749 in the Office of the Clerk of the County Commission of Kanawha County, West Virginia. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
