The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated October 14, 1999, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed of Trust Book 5000, at Page 9202, Samuel Joseph Walk did convey unto Otis L. O’Connor, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse, in Beckley, West Virginia, on
March 17, 2020, at 1:49 p.m.
The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Clear Fork District, Raleigh County, West Virginia, and more particularly described as follows:
All those certain lots, tracts or parcels of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Clear Fork District, Raleigh County, West Virginia, and being more particularly bounded and described as follows:
BEGINNING at a point in the northern right of way line of Route 1, said point also being the southwestern corner of Tract No. 1, thence running with the original line of Tract No. 1 the following four courses and distances: N 06 degrees – 55′ E. 31.52 feet to a point; N 20 degrees – 31′ E. 44.80 feet to a point; N. 03 degrees – 19′ W. 22.03 feet to a point; N. 83 degrees – 39′ W. 37.47 feet to a point at the northern common corner of Tract 1 and Tract 2; thence N. 78 degrees – 59′ W. 5.20 feet, running with Tract 2 to a point; thence S. 11 degrees – 01′ E. 90.18 feet, running through Tract 2 to a point in the said northern right of way line of said Route 1; thence S. 81 degrees – 20″01′ W. 78.70 feet, chord distance to the point of beginning, containing 5,417.49 square feet, more or less.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of Clear Fork Road, Dorothy, WV 25060. We have reason to believe the property has a current mailing address of 8838 Clear Fork Road, Dorothy, WV 25060.
AND BEING the same real estate which was conveyed to Samuel Joseph Walk by Deed dated September 22, 1999, from Michael Nelson and Jada Nelson, and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 5000, at Page 9201.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
