Notice is hereby given that the undersigned Trustee, will sell at public auction to the highest bidder on:
Wednesday, March 11, 2020, at 10:00 a.m.,
at 11 Locust Avenue, Wheeling, Ohio County, West Virginia, that certain property conveyed by George E. Carroll, Sr. and Harlean Carroll, husband and wife, to James C. Gardill, Trustee, by Deed of Trust dated December 18, 2003, and recorded in the office of the said Clerk of the County Commission of Ohio County, West Virginia, in Deed of Trust Book 1221, at page 201, and being described as follows:
A certain lot or parcel of real estate, together with, the buildings and appurtenances thereunto belonging, situate in the City of Wheeling, Ohio County, West Virginia, which said parcel is shown and defined as the Lot Numbered Twenty-two (22) on the “Map of Lenox”, and which said Map is recorded in the Office of the Clerk of the County Court of Ohio County, West Virginia, in Plat Book 2, at page 14.
And the said party of the second part, his heirs and assigns, hereby covenants with the said parties of the first part, their heirs and assigns, that there shall not be permitted or caused to be erected within the space of twenty (20) feet measured from the front line of the property hereinbefore described, any building or other structure whatsoever, excepting an open porch, piazza or stoop.
And the said party of the second part, his heirs and assigns, also covenants with the said parties of the first part, their heirs and assigns, that any principal building or dwelling house which shall be erected upon the said lot shall cost not less than the sum of Forty-five Hundred Dollars ($4,500.00).

The following described parcel of real estate situate in the City of Wheeling, Triadelphia District, Ohio County, West Virginia, that is to say:
A piece or parcel of real estate being part of Lot Numbered Twenty-three (23) as shown and defined on the “Map of Lenox”, which Map is recorded in the office of the Clerk of the County Court of Ohio County, West Virginia, in Plat Book No. 2, at page 14, bounded and described as follows, to-wit:
Beginning at a stake at the northeasterly corner of said Lot Numbered Twenty-three (23) and running along the easterly boundary line of said Lot in a southerly direction one hundred and fourteen (114) feet to a stake; thence in a westerly direction along the southerly boundary line of said Lot, sixteen (16) feet to a stake; thence in a northerly direction along a line parallel with the easterly boundary line of said Lot Numbered Twenty-three (23), one hundred and fourteen (114) feet to a stake in the northerly boundary line of said Lot; thence along Locust Avenue with the northern boundary line of said Lot, sixteen (16) feet in an easterly direction to the place of beginning; together with all and singular the improvements thereon and the appurtenances and hereditaments thereunto belonging.
This conveyance is subject, however, to the building line restriction and the other reservations, limitations and restrictions set forth in the Deed from Cecil R. Hamilton and Rena Hamilton, his wife, to James B. Youngson, dated the 4th day of October, 1949, and recorded in said County Clerk’s Office in Deed Book No. 318, at page 357.
Being the same property conveyed to George E. Carroll, Sr., party of the second part, by August W. Petroplus and Bessie G. Petroplus, his wife, parties of the first part, by Deed dated March 14, 1966, and recorded in the Office of the County Clerk of Ohio County, in Deed Book 471, at page 346.

The terms of the sale will be as follows: Cash in hand on the day of sale. Sale of said property will be made subject to: (1) All prior exceptions, reservations, rights of ways easements, conditions, covenants, restrictions, leases and other servitude’s of record if any pertaining to said real estate: (2) any and all unpaid taxes assessed against said property: (3) The subject property will be sold in “as is” condition: (4) The Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property: (5) The Trustee will deliver a Trustee’s Deed to the purchaser without any covenant or warranty (expressed or implied) in the form prescribed by West Virginia Code Chapter 38-1-6. The Trustee makes no representations and warranties about the title of the real estate to be conveyed.
Any sale hereunder may be adjourned from time to time without notice other than oral proclamation at the time and place appointed for the sale. The Trustee reserves the right to reject any or all bids. Additional terms and conditions shall be announced at the sale.
Any sale hereunder in which the property is encumbered by Federal Tax Liens will be subject to the 120 day redemption period pursuant to 26 U.S.C.A. Section 7424(d).
