TO: BEEREN REAL ESTATE LLC 206 MANOR DRIVE BECKLEY, WV 25801 NOTICE OF SALE Under authority of a certain A Deed of Trust dated July 8, 2011, from BEEREN RENTAL ESTATES LLC, a West Virginia limited liability company, to Anthony Marks and Percy Osborne, Trustees, securing First Bank of Charleston, Inc., now known as Premier Bank, Inc., in the amount of $33,760.80, of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia in Trust Deed Book 3806, at page 838, default having been made in the payment of the obligation secured by said Deed of Trust, and sale having been requested in writing by the holder of the indebtedness secured, the undersigned, Raymond G. Dodson, Substitute Trustee, by virtue of Notice of Substitution of Trustee dated February 13, 2020, and recorded in the aforesaid Clerk’s Office in Trust Deed Book 4408, at page 877, will offer for sale at the front door of the Kanawha County Courthouse on Virginia Street, Charleston, West Virginia, on March 24, 2020, at 11:00 o’clock, the certain real estate conveyed in said Deed of Trust, which is known as 609-613 Washington Street, Charleston and is further founded and described as follows: All that certain lot, tract or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of Charleston, Charleston West District, Kanawha County, West Virginia, and now known as Nos. 609-611-613 Lee Street, West (formerly Fayette Street) being more particularly described as follows: Beginning at an iron pin at the intersection of the westerly side of said Fayette Street (now known as Lee Street, West) and with the northerly line of the New York Central Railway right of way line; thence with the northerly line of said railway right of way, N. 68 22′ W. 62.5 feet to an old iron pin; thence with the southerly boundary and division line of the Alfred O. Lee property (formerly L. H. Samples), as established by the Hallie M. Kendall and Alfred O. Lee by agreement dated April 18, 1955, and recorded in the aforesaid County Clerk’s office, N. 37 08′ E. 41.4 feet, which said line also partly runs with the northerly side of a one-story cinderblock building located on the property herein conveyed; thence with the westerly line of said Lee Street, West, and a concrete walk, and also passing another walk running from said concrete walk across the lot herein conveyed to the northerly line of said railway right of way, S. 30 30′ E. 65.0 feet to the place of beginning; and being more fully depicted on that map entitled “Part of Block “40: of Glenwood Add’n., Located in the City of Charleston, Kanawha County, W.Va., Presently Owned by Greenwood Realty, Inc., to be conveyed to Jackie E & Betty Jane Chandler, Nos. 609, 611 & 613, Lee Street E.”, prepared by Field Engineering Co., and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 1757, at page 749. This conveyance will also be made subject to any and all reservations, exceptions, restrictions, rights of way and easements contained in prior deeds affecting said property of record in said Clerk’s office or visible on the ground. This property will be conveyed by Trustee together with the hereditaments thereof and all building, structures and improvements now or hereafter situate thereon and all fixtures, materials, supplies, equipment, machinery and other property as is now or may hereafter be an accession thereto, be a fixture thereto, or be otherwise treated or deemed as a part of the land described herein, all of which is included in the term “property” as used herein. By way of example and not by way of limitation, such fixtures and accessions shall include heating, cooling and air-conditioning units, plumbing and electrical fixtures and equipment, built-in appliances of every kind, boilers, machinery, motors, wall-to-wall carpeting, storm doors and windows, awnings and all furnishings attached to the property. The above-described real estate will be conveyed by the undersigned Trustee to the purchaser by deed containing a Covenant of Special Warranty and subject to all liens, reservations and exceptions appearing in the record of title, and to the lien of all unpaid taxes, if any, which are entitled to priority over the lien of the aforesaid deed of trust. Purchaser must pay all transfer taxes, delinquent or current real estate taxes, title search and any costs related to recording of any Deed from the Trustee herein. TERMS OF SALE Any successful bidder shall pay 10% of the sales price as a deposit in Certified Funds or Cash at the time of sale with the balance to be paid within 30 days from date of sale. The above-described real estate will be sold by the undersigned Substitute Trustee by auction to the highest bidder subject to the right of the Trustee to reject all bids if in his opinion they are inadequate. The owner of the indebtedness secured by the above-described deeds of trust and the owner of any other interest in the properties to be sold shall have the right to bid.
