NOTICE OF SUCCESSOR TRUSTEES’ SALE OF REAL PROPERTY Notice is hereby given that, by virtue of the authority vested in the undersigned Katie L. Monroe and James M. Davis, as Successor Trustees, by Credit Line Deed of Trust made and executed by Mafalda Ida Wheeler to James C. Gardill, as Trustees, dated November 19, 2008, recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Trust Deed Book 3612, at Page 195 (the “Credit Line Deed of Trust”); and the said Katie L. Monroe and James M. Davis, acting as Successor Trustees under and by virtue of a certain Appointment of Successor Trustees, dated September 9, 2019, and recorded in the aforesaid Clerk’s office in Trust Deed Book 4383, at Page 113; and default having been made in the payment of the note secured by the Credit Line Deed of Trust, the owner and holder of said note, having elected to treat the whole principal debt secured by the Credit Line Deed of Trust as immediately due and payable and having requested in writing the sale of the real estate conveyed by the Credit Line Deed of Trust; NOW, THEREFORE, the undersigned Successor Trustee, having been required so to do by said holder, WesBanco Bank, Inc., will sell the real estate conveyed by the Credit Line Deed of Trust, together with Joe R. Pyle Complete Auction and Realty Service, at public auction to the highest bidder at the front door of the Courthouse of Kanawha County, West Virginia, in the City of Charleston, West Virginia, on March 31, 2020, at 12:00 p.m., local time, and which said real estate is more particularly described in the Deed of Trust as follows: All of those certain lots or parcels of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of Charleston (South Annex), Kanawha County, West Virginia, and being known and designated as Lots Nos. Two (2) and Three (3), as shown and laid down upon a map of the “Vorholt Addition to Fern Bank” dated September 30, 1918, made by B.M. Green, Civil and Mining Engineer, re-surveyed by W.D. Sell as of February 28 and March 1, 1938, and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia in Photostatic Map Book 3, at page 113. And being the same property conveyed to Travis Haden Wheeler and Mafalda Ida Wheeler, as joint tenants with the right of survivorship and not tenants in common, by Albert Edward Older and Bonnie Dale Older, his wife, by deed dated September 5, 1975, of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia in Deed Book 1770, at page 641. The said Travis Haden Wheeler having died in Kanawha County, West Virginia on November 11, 1997. This conveyance is made subject to such rights of way, easements, restrictions, covenants, conditions and reservations as may be found in prior deeds of record in the chain of title. At the time of the execution of the Credit Line Deed of Trust the property address was reported to be: 231 Oakwood Road, Charleston, WV. The above-described real estate will be conveyed by the undersigned Successor Trustees by deed without warranty of any kind, express or implied, and subject to all prior liens, and further subject to all unpaid real estate taxes or assessments, encumbrances and claims in favor of public service districts / municipal sanitary boards, if any, and also further subject to any covenants, restrictions, conditions, reservations, rights of way and easements of record in the aforesaid Clerk’s office and affecting the subject real estate, and without responsibility for or representations as to any items of personal property located thereon; and, any party claiming an interest in any item of personal property is responsible for the removal thereof prior to the date of sale. TERMS OF SALE 1. Ten Percent (10%) nonrefundable down payment required on day of sale along with a Ten Percent (10%) Buyers Premium to be added and due on the day of sale with the balance due at closing by certified or cashier’s check, or cancellation of existing indebtedness in the discretion of the Successor Trustees. No financing contingencies and closing to take place within thirty days (30) of the day of sale; 2. Subject to any prior deeds of trust or security agreements of record; 3. Subject to any special assessments or any liens for taxes; 4. The successful bidder shall be responsible for the payment of the transfer taxes imposed by West Virginia Code 11-22-2. 5. The above-described real estate will be sold by the undersigned Successor Trustees by auction to the highest bidder subject to the right of the undersigned Successor Trustees to reject all bids if, in their opinion, said bids are inadequate; 6. The owner of the indebtedness secured by the Deed of Trust shall have the right to bid; and 7. The above-described real estate will be sold in “AS IS” condition. The sale shall be without representation or warranty of any kind, express or implied. 8. Such other terms as may be announced at the time of sale.
