ORDER OF PUBLICATION
Mary V. Davis died intestate on January 3, 1923 seized and possessed of the hereinafter described property which was inherited by the following individuals, being May Mellott, Rosa E. Stackhouse, Nora B. Parsons, Ray Davis, James Davis, Joseph Davis, Jeff E. Davis, and Dorothy Davis. The subject real estate is situate in Proctor District, Wetzel County, West Virginia described as follows:
BEGINNING at a cliff of rocks on the run corner to J. W. Monroe and the Haines heirs, thence North 69 1/2
degrees East 945 feet to a locust stake close by a locust stump in line between W. H. Davis and J. W. Monroe, thence North 20 degrees West 200 feet to a hickory, thence South 88 1/2 degrees West 1148 feet crossing Narrows Run to a water beech corner in line of J. W. Monroe and Haines heirs, thence with and up the run South 34 1/2 degrees East 594 feet to the beginning, containing nine (9) acres, more or less.
By deed dated January 8, 1923 and recorded in Deed Book 144, at page 362, May Mellott, Rosa E.
Stackhouse, Nora Parsons, Joseph Davis and Jess E. Davis conveyed their interest in this property to Roy M. Davis. This deed effectively transferred an undivided 5/8 interest in this property. Roy M. Davis already owned an undivided 1/8 interest. Therefore, by the aforesaid
inheritance and by the deed Roy M. Davis owned an
undivided 6/8 interest.
By deed dated August 19, 2009 Ryan J. Morgan Special Commissioner, pursuant to Civil Action Number 08-C-124 conveyed the hereinabove described property to Jeff E. Davis. However, James Davis and Dorothy Davis are not named as Defendants in the civil action.
The object of the above-entitled civil action is to obtain an Order as follows:
a. that the Plaintiff be declared the owner of the
aforesaid described 9 acre, more or less, parcel of real estate;
b. the existence and location of James Davis is
unknown and cannot be determined and therefore James Davis or the Unknown Heirs of James Davis be made parties to this civil action; and,
c. the existence and location of Dorothy Davis is
unknown and cannot be determined and therefore Dorothy Davis or the Unknown Heirs of Dorothy Davis be made parties to this civil action.
It is ORDERED that the Defendants do serve upon
Logan Hassig, Plaintiff’s attorney, whose address is Post Office Box 189, New Martinsville, West Virginia 26155, an Answer of their defense to the Complaint filed in this civil action on or before the 27 day of March, 2020, otherwise judgment by default will be taken against them at anytime hereafter. A copy of the
Complaint can be obtained from the undersigned Clerk at her office.
