NOTICE OF SALE BY SUBSTITUTE TRUSTEE UNDER TRUST DEED Notice is hereby given that the undersigned, Stephen P. Swisher, Trustee, under that certain Deed of Trust executed by STEVE EDWARD MEANS, to Stephen P. Swisher, Trustee, to secure David William Compton, dated 15th day of September, 2011, and duly of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia in Trust Deed Book 3824, at page 441. The maker of the note and obligation described in that Deed of Trust having failed to pay the same as provided for under the terms of the same note and Deed of Trust, and the holder of the note having declared the whole to be due and payable, and having instructed the undersigned Substitute Trustee in writing to make sale of the real estate described in the same deed of trust referenced above, the undersigned Substitute Trustee will sell at public auction for cash to the highest bidder on Wednesday, July 15, 2020 at 1:30 p.m., at the front door of the Courthouse of Kanawha County, West Virginia, on Virginia Street, in Charleston, West Virginia, all that certain real estate with all tenements, hereditaments and appurtenances thereunto belonging, or in any wise appertaining, and all improvements thereon being situate in Jefferson District, Kanawha County, West Virginia situate in Dunbar District, Kanawha County, West Virginia, and being known and designated as follows: PARCEL NO. 1: The front 90 feet of Lot No. 19 and 2 feet off of the southwesterly side of Lot No. 20 lying adjacent to said Lot No. 19, in Block Y of the City of Dunbar, with a depth of 90 feet, making a lot fronting 32 feet on the westerly side of 16th Street, and having a depth of 90 feet; PARCEL NO. 2: The rear 70 feet of Lot No. 19 and the rear 70 feet of a 3 foot strip off the southwesterly part of Lot 20, in Block Y of the City of Dunbar, and extending from the rear of the Parcel No. 1 in this deed to a 15 foot alley, and making a parcel adjacent to said alley with a uniform width of 33 feet and extending back towards 16th Street for a distance of 70 feet, more or less; and being the same property conveyed to Steve Edward Means by David William Compton by Deed dated September 15, 2011, reference being made to said map and deed for a more particular description of the property herein conveyed. . FEDERAL TAX LIEN. In the event that there are federal tax liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of said such sale or the period allowed for redemption under law, whichever is longer. This sale is subject to any special assessments, unpaid taxes, liens for unpaid taxes, conditions, reservations, easements, restrictions and covenants affecting the real estate as such exist and may appear from any and all instruments that comprise the chain of title of the real estate. The undersigned Trustee reserves the right to reject any and all bids. Any successful bidder shall be required to deposit with the Trustee on the date of sale a deposit of not less than ten percent (10%) of the successful bid price by certified funds or appropriate letter of credit issued by a recognized lending institution. Any successful purchaser of the aforesaid real estate shall take the same in its current condition and the Trustee herein and the secured parties herein make no warranties whatsoever relative to the physical condition of any improvements situate on the aforesaid real estate. The Trustee herein reserves the right to continue and/or adjourn the sale advertised hereunder by public proclamation to a time and date deemed appropriate by the undersigned Trustee.
