NOTICE OF CONDEMNATION TO: RESPONDENTS, CLARA A. DETAMORE; MICHAEL Y. RUTHERFORD, SHERIFF OF KANAWHA COUNTY; and the UNKNOWN HEIRS OR BENEFICIARIES OF THE ESTATE OF REUBEN L. JONES, DECEASED You, and each of you, are hereby notified that on the 20th day of July, 2020, at 1:30 p.m., or as soon thereafter as the matter may be heard, the Board of Education of the County of Kanawha will make application to the Circuit Court of Kanawha County in Charleston, West Virginia, for: 1. A determination by the Court of the right of the Petitioner to condemn and appropriate for public purposes the interests in real estate shown and described in the Petition for Condemnation and for Right of Entry filed herein; 2. The entry of an Order vesting indefeasible title to said interests in Petitioner and authorizing Petitioner at once to enter upon, to take possession of, and appropriate said interests in real estate for the public purposes set forth in the Petition filed herein; 3. The appointment of Commissioners to ascertain just compensation to the person or persons entitled thereto for the interests in property sought to be taken herein; and 4. Such orders and proceedings as may be then and there had as may be necessary to acquire by eminent domain the interests in real estate described for the public use and purposes set forth in the attached Petition. The interests in real estate to be condemned are proposed to be taken for the construction of a new elementary school for the residents of the area of Clendenin, West Virginia, as more particularly described in the Petition, and will be appropriated by Petitioner under and by virtue of the powers and authority vested in it by Chapter 54-1-1 et seq. of the Code of West Virginia, as amended, and generally the laws of the State of West Virginia.
