TO: RESPONDENTS, JANICE SUE STEWART, JIRL LEON BRUNTY, ONA LOUISE RAMEY, CAROL LYNN MCCOY AKA CAROL LYNN ELK, UNKNOWN PERSONS/OWNERS, AND GARY LINVILLE, SHERIFF OF LINCOLN COUNTY, WEST VIRGINIA Notice is hereby given to Janice Sue Stewart, Jirl Leon Brunty, Ona Louise Ramey, Carol Lynn McCoy aka Carol Lynn Elk, Unknown Persons/Owners, and Gary Linville, Sheriff of Lincoln County, West Virginia (hereinafter sometimes referred to as “the aforementioned respondents”) that a Petition for Condemnation/Right of Entry has been filed in the Circuit Court of Lincoln County, West Virginia, and is known as Civil Action No. 20-C-16, and styled Appalachian Power Company vs. Janice Sue Stewart, et al. Said Petition for Condemnation/Right of Entry under the West Virginia laws of eminent domain seeks property for the construction of electrical transmission, distribution, and communication lines and appurtenant equipment and fixtures, and condemnation and right of entry on behalf of Appalachian Power Company situate on the waters of Silvermine Branch of Four Mile Creek, Laurel Hill District, Lincoln County, West Virginia, and identified as Tax Map 5, Parcel 1, and recorded in Deed Book No. 296, at page 348, in the office of the Clerk of the County Commission of Lincoln County, West Virginia, and bounded and described as follows: SUR 75.33 ACRES FOUR MILE BEING the residue of a 162.86 tract or parcel of real estate conveyed to Mamie Brunty by deed dated April 14, 1941, from J. T. Ferrell and Bertie Jewell Ferrell, of record in the Office of the Clerk of the County Commission of Lincoln County, West Virginia, in Deed Book 119, page 400, it being understood that the land book entry currently is surface 80.60 acres on Four Mile, Map 5, Parcel 01. The aforementioned respondents are hereby notified a copy of said Petition for Condemnation/Right of Entry may be obtained from the Lincoln County Circuit Clerk’s office at 8000 Court Avenue, Hamlin, West Virginia, 25523, for the purposes of appearing and defending. The Petition for Condemnation/Right of Entry may also be obtained from the attorneys for Appalachian Power Company, Stephen F. The aforementioned respondents are further notified that a hearing on the said Petition for Condemnation/Right of Entry will occur on July 17, 2020, at 10:00 a.m., in the Circuit Court of Lincoln County, West Virginia, located at 8000 Court Avenue, Hamlin, West Virginia, 25523, before the Honorable Jay M. Hoke. You may appear for hearing as stated above, and are notified that any failure to appear may result in the waiver of any defenses or claims, if any, you may have.
