NOTICE OF TRUSTEE’S SALE Notice is hereby given, by virtue of the authority vested in the undersigned, J. Nicholas Barth, Successor Trustee, by that certain Deed of Trust made by Buddy E. Jones and Ramona L. Jones to P. Michael Pleska and F. Thomas Graff, Jr., Trustees, bearing date March 24, 2006, and of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Trust Deed Book 3340 at page 706; the said J. Nicholas Barth acting as Successor Trustee by virtue of that certain Appointment of Successor Trustee dated the 9th day of July, 2020, of record in the aforesaid Clerk’s Office in Trust Deed Book 4436 at page 744; and default having been made in the payment of the Note secured by the aforesaid Deed of Trust, and having been requested in writing by the owner and holder of the Note, the undersigned Successor Trustee will offer for sale, at public auction, to the highest bidder at the North Front Door of the Courthouse of Kanawha County, West Virginia, in the City of Charleston, West Virginia, on Thursday, the 27th day of August, 2020, at 9:30 o’clock a.m., all that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Elk District, Kanawha County, West Virginia, and being more particularly bounded and described as follows: BEGINNING at a surveyors P-K nail (set) in the eastern right of way line of West Virginia Route 47, said corner being situate at S.31 58’17″E., 19.60 feet from APCO Pole Number 97A133, 1/56, and S.81 05’05″W., 28.56 feet from a two story apartment building northwestern most cinder block corner, said corner being on the south side of an existing nineteen foot wide road right of way, thence running with the right of way line of Route 47, S.26 47’59″E., 111.00 feet to a 1 1/2 inch diameter iron pipe (found) with threaded top, being a common corner to a parcel of Ronald and Teresa K. Preast, said corner is situate N.35 08’25″E., 5.70 feet from APCO Pole Number 97A61, 1/57, and S.18 25’23″E., 15.19 feet from an existing water meter, thence leaving the road right of way and running with Preast N.64 21’35″E., 172.06 feet to a 3/4 inch diameter iron pipe (found) painted with galvanized paint flush with ground, said corner being common to a parcel of land of Connie S. Armstead as recorded in Deed Book 2132, at page 461, and also in the Mary M. Engle line from which this parcel is being severed, thence leaving Armstead and Preast and running with a new division line through the Mary M. Engle land N.25 52’14″W., 88.55 feet passing through the rear of an existing block garage as shown upon a plat of this survey to a 5/8 inch diameter rebar (set) in the first mentioned nineteen foot wide road right of way, thence running with the southern side of said road right of way S.71 42’16″W.,175.39 feet to the place of beginning, and containing 17,245 square feet or 0.396 acre as shown on a plat of this survey made by Albert J. Miller, Licensed Land Surveyor, And being the same property conveyed unto Buddy E. Jones and Ramona L. Jones by deed dated June 27, 1993, from Mary M. Engle, of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 2318 at page 860. Said property having address of 215 North Pinch Road, Elkview, West Virginia 25071. The referenced property will be conveyed with covenants of special warranty subject to all further covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground. TERMS OF SALE: Cash in hand at time of sale, subject to all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. Pursuant to the terms of the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated and act by agent in the execution of the sale.
