NOTICE OF PUBLIC HEARING FOR APPLICATION TO THE STATE OF WEST VIRGINIA DEVELOPMENT OFFICE REGARDING CREATION OF THE COUNTY COMMISSION OF KANAWHA COUNTY DEVELOPMENT DISTRICT NO. 1 (ELKVIEW REVITALIZATION DISTRICT), APPROVAL AND IMPLEMENTATION OF PROJECT PLAN NO. 1 AND ISSUANCE OF TAX INCREMENT FINANCING OBLIGATIONS A public hearing will be held on the proposed Application for the creation of The County Commission of Kanawha County Development District No. 1 (Elkview Revitalization District) (the “TIF District”) and approval of Project Plan No. 1 (the “Project Plan”) for the TIF District at a regular meeting of The County Commission of Kanawha County, West Virginia (the “County Commission”), on August 13, 2020, at 5 p.m., in the County Commission meeting room at the Kanawha County Courthouse, in the Commission Courtroom, located at 409 Virginia Street East, Charleston, West Virginia, and at such hearing any person interested may appear and present comments, protests and suggestions. All comments, protests and suggestions shall be heard by the County Commission, and it shall then take such actions as it shall deem proper in the premises regarding the approval pursuant to Chapter 7, Article 11B of the Code of West Virginia, 1931, as amended (the “Act”), of a Tax Increment Financing Application (the “TIF Application”) regarding creation of the TIF District and approval of the Project Plan, pertaining to the construction and improvement of certain public improvements within the TIF District including (i) remediation and site preparation for the Elkview Commons Development to be located within the TIF District, (ii) construction and relocation of certain utility infrastructure, including but not limited to electric, gas, broadband, sewer, water, stormwater and telephone, necessary for the Elkview Commons Development to be located within the TIF District, (iii) construction of roads, roadways, intersection improvements and traffic controls within or benefiting the TIF District, (iv) stream remediation and rehabilitation, (v) construction of other public infrastructure improvements within or benefiting the TIF District, and (vi) paying related engineering, legal, administrative and other professional costs (the “TIF Project”). Following is a brief summary of such matters. Approval for creation of the TIF District The County Commission proposes to send the TIF Application to the West Virginia Development Office to create the TIF District. The TIF District will be located off of I-79 in the unincorporated area known as Elkview West Virginia in the Elk District of Kanawha County. It is comprised of approximately 1,178.16 acres and has no county zoning requirements. A map of the proposed boundaries of the TIF District is on file with the Clerk of the County Commission of Kanawha County in the TIF Application. Approval of the Project Plan The County Commission proposes a Project Plan which would provide for additional development within the TIF District, consisting of public improvements, including (i) remediation and site preparation for the Elkview Commons Development to be located within the TIF District, (ii) construction and relocation of certain utility infrastructure, including but not limited to electric, gas, broadband, sewer, water, stormwater and telephone, necessary for the Elkview Commons Development to be located within the TIF District, (iii) construction of roads, roadways, intersection improvements and traffic controls within or benefiting the TIF District, (iv) stream remediation and rehabilitation, (v) construction of other public infrastructure improvements within or benefiting the TIF District, and (vi) paying engineering, legal, administrative and other professional costs of the TIF Project. Approval for Tax Increment Financing Obligations The County Commission proposes to issue tax increment revenue bonds or other obligations (the “TIF Obligations”) in one or more series in an aggregate principal amount not to exceed $6,000,000, with maturities not to exceed 30 years from the date of the creation of the TIF District to (i) finance the costs of the Project, (ii) finance the costs of obtaining approval of the creation of the TIF District and the Project Plan, (iii) fund reserves for the TIF Obligations, as necessary, (iv) fund capitalized interest on the TIF Obligations, as necessary, and (v) pay costs of issuance of the TIF Obligations and other related costs. Such obligations may be issued from time to time in one or more series. A portion of the costs of the Project may also be paid directly from tax increment revenues or other sources if available. Further information regarding the proposed TIF Application and the TIF Obligations are on file and available for inspection at the office of the Clerk of the County Commission during regular business hours, located at the County Clerk’s office in the Kanawha County Courthouse, 409 Virginia Street E.
