NOTICE OF SUCCESSOR TRUSTEE’S SALE Notice is hereby given, by virtue of the authority vested in the undersigned Successor Trustees, Eric M. Johnson and R. Douglas Calderwood, by that certain Deed of Trust made by Raymond C. Gould and Kathryn A. Gould, dated March 8, 2012, and recorded March 13, 2012 in the office of the Clerk of the County Commission of Kanawha County, West Virginia in Trust Deed Book 3858 at page 413, the said Successor Trustees acting by virtue of that certain Appointment of Successor Trustee dated August 11, 2020 and recorded August 14, 2020 in the aforesaid Clerk’s office in Trust Deed Book 4442, at page 308, and default having been made in the payment of the Note secured by the aforesaid Deed of Trust, and having been requested in writing by the owner and holder of the Note, will offer for sale, at public auction, to the highest bidder at the front door of the Courthouse of Kanawha County, West Virginia, on September 22, 2020 at 9:00 a.m., all that certain lot, piece or parcel of real property, together with improvements thereon, situate in Charleston, Charleston South Annex District, Kanawha County, West Virginia, being more particularly bounded and described as follows: All of that certain lot or parcel of land, together with the appurtenances thereunto belonging, situated in the City of Charleston, Loudon District, Kanawha County, West Virginia, in Fort Hill, an addition to the said City of Charleston, which parcel is more particularly bounded and described as follows: BEGINNING at an iron pin in the northerly line of Sheridan Circle, front common corner between the parcel hereby conveyed and Lot 405 of Fort Hill, heretofore conveyed by Fort Hill Development Company, a corporation, to V. Virgil Tilton and Lorena Jividen Tilton, his wife, by deed dated May 15, 1959, and of record in the Office of the Clerk of the County Court of Kanawha County, West Virginia, in Deed Book 1283, at page 292; thence with the west line of the said Tilton property, N. 3 54′ W., 116.86 feet to an iron pin, in the south line of Lot 417, of Fort Hill; thence with part of the line of Lot 417, N. 88 41′ W., 13.23 feet to an iron pin, rear corner between Lots 416 and 417; thence with the rear line of Lot 416, S. 80 23′ W., 57.14 feet to an iron pin, rear corner between Lots 415 and 416; thence with the rear line of Lot 415 S. 59 17′ W., 51.46 feet to an iron pin, rear corner between Lots 414, 415, and Lots 407 and the property hereby conveyed; thence with the east line of Lot 407, heretofore conveyed by Fort Hill Development Company, a corporation, to Lysander B. Dudley, by deed dated February 1, 1957, of record in the aforesaid Clerk’s Office in Deed Book 1200, at page 61, and by corrective deed between the same parties dated October 1, 1957, recorded in the aforesaid Clerk’s Office in Deed Book 1228, at page 503, S. 28 55′ E., 114.96 feet to an iron pin in the north line of Sheridan Circle; thence with a curve to the right, the chord of which bears N. 73 32′ E., for a chord distance of 69 feet to the place of beginning, being all of Lot 406 of Fort Hill. And being the same property conveyed unto Raymond C. Gould and Kathryn A. Gould, his wife, by Roy M. Morris, Jr. and Jean O. Morris, his wife, by deed dated October 9, 1967, of record in the aforesaid Clerk’s Office in Deed Book 1504, at page 195. This conveyance is made subject to those covenants, restrictions and reservations contained in that certain deed from Sallie C. Stewart, widow, unto Roy M. Morris, Jr. and Jean O. Morris, his wife, dated April 26, 1965, of record in the aforesaid Clerk’s Office in Deed Book 1438, at page 332. This conveyance is made subject to any and all covenants, restrictions, and easements as the same may appear in instruments of record in the aforesaid Clerk’s Office. At the time of execution of the deed of trust, the grantor represented that the address of the property was 414 Sheridan Circle, Charleston, WV 25314. TERMS OF SALE: The Premises will be sold “AS IS, WHERE IS,” in its present condition and with all faults and defects, if any. The property will be conveyed by deed with no covenants of warranty of title. The property shall be sold subject to all liens not discharged by the sale, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges and liens with priority to the Deed of Trust pursuant to which this sale is being conducted. The property shall be sold subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s office or visible upon the ground. The property will be sold for cash in hand on the date of sale to the highest bidder. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamps to be affixed to the deed). The Successor Trustees and City National Bank of West Virginia shall not be responsible for the removal of any person or personal property from the Premises. Pursuant to the Deed of Trust, the Successor Trustees may postpone the sale by public announcement at the time and place designated and act by agent in the execution of the sale.
